The government says destroying his own data during an airport interrogation was illegal.
In early 2025, Atlanta resident Samuel Tunick was on his way home following a trip abroad. After landing in the US, customs agents demanded access to his Pixel phone, which was running an alternative version of Android called GrapheneOS. Rather than hand over his data, Tunick used a clever feature of the software to delete everything. Now, he’s facing federal charges.
The first hearing in this case happened last week, according to The Guardian, during which government attorneys and agents claimed that Tunick was subjected to a standard secondary interrogation at an international airport. During that encounter, agents were “looking for anything that’s prohibited.” However, Tunick’s legal team alleges he was targeted for his activism.
Tunick was involved with a group called Defend the Atlanta Forest, which opposed the construction of an enormous law enforcement training facility in the area often known as Cop City. What Tunick didn’t know, according to his lawyers, was that he’d been placed on a watch list for his actions and that Customs and Border Protection had discussed over email plans to detain him upon his arrival back in the US for “suspected terrorism activities.”
This, by the by, is why it was always a bad idea to justify suspension of rights for "known or suspected terrorists"--yes, there's a law enforcement definition of terrorist[1], but at the end of the day, it's a political label[2].
The current regime wants to call everyone who opposes ICE, who is not aligned with Trump, and who does not wholly support Zionism a terrorist. If you've ever spoken out against Cop City, Datacenters, Palantir, ICE, GEO Group, IDF conducting genocides, and other things that the current regime wants to use against the citizens, residents, and guests of the United States? They want to label you a terrorist.
In the US, law enforcement is not supposed to be able to seize your phone, laptop, or other personal effects without a signed judicial warrant that specifically states what they're seizing, what they're looking for, and why.
What CPB did violated his rights. Their actions were unlawful, as they violated the US Constitution[3]. Much like many other enforcement actions taken against individuals in the United States.

One might easily "identify" a foreign religious extremist as a terrorist while ignoring identical behavior in a domestic religious extremist. You can look at what ICE and the current regime are doing and see that it also falls under the above definition of terrorism.

In a non-dysfunctional era, the Supreme Court would strike down laws, policies, and other official decisions and orders that violated the Constitution because the intention is that if it does not follow the Constitution, it cannot be lawful.
