Biggest takeaways from today’s federal hearing (January 9):

- Luigi looks healthy.

- his hands were not shackled but his feet still were.

- a trial date was not set today due to pending motions in his federal case.

- Jacob Kaplan argued that the cops did not have the right to read the journal, but cops read it anyways without a warrant. Judge Garnett does not think this was relevant due to the fact that they got a search warrant for the journal after.

- Jacob Kaplan also argued that the cops should not have taken the bag at McDonald’s - since it was moved away while talking to Luigi. The judge thinks that they can’t just leave his personal belongings while arresting him, stating that Luigi said the bag was his.

- Mr Patel ( Team Lead for Maryland Federal Public Defenders) added new lawyer of Luigi argued for dismissal of counts 3 and 4

- Mr Patel argued that the stalking count doesn’t constitute a “crime of violence”.

- both Patel (defense) and Xiang (prosecution) presented arguments whether staking predicate violence.

- Xiang (prosecution) argued that the issue appears to be wether the defendant “knowingly” engaged in conduct that places a victim in a reasonable fear that they are going to be harmed.

- judge Garnett also mentioned that she won’t rule on this motion during the hearing. A written decision will be issued.

- another hearing is set for Friday January the 30th at 11 am.

- depending whether the stalking counts 3 and 4 are still on the table. Both parties suggested following trial dates:

Not capital trial : jury selection for trial starts on September the first

Capital trial: trial will start early January of 2027.
