Land Back: A Guide to Returning Stolen Land To Your Indigenous Community By Corinne Rice and Andrew Perera
Today’s lesson is written in partnership with my younger brother Andrew. He holds a Masters of Jurisprudence in Indian Law from the University of Tulsa, College of Law. He and I worked very hard on this lesson for you guys and hope to give you all a better understanding of the process of returning land to Tribal Nations and some action items for you too!
Let’s start with the colonial understanding of land ownership and how that differs from the Indigenous idea of land stewardship. When we say “Land back!” We are forced to argue this within the colonial construct of ownership, so that we can have our lands to practice stewardship. Care of the land. Traditionally we as indigenous people (and I speak for my cultures not pan-indigenously) do not OWN land. We cannot own your mother.
But because we exist in a space that is controlled by a federal government that requires things like deeds of trust etc, we fight in that arena. With their tools. We were forced to sign Treaties. A colonial construct as well, but we understand that the Wasicu (white man) values his legal papers.
Now that we have that understanding… Can land belong to a Tribal Nation? Yes! But we need to talk about Johnson v. McIntosh first.
In 1823 the Supreme Court saw a case that started what many know to be the Holy Trinity of fucking over Tribal nations and sovereignty. Johnson v. McIntosh established the idea that Tribal Nations were incompetent and unable to care for their own lands, and deemed entire nations to be “wards of the federal gov.” Tribal lands were then decided to be held in trust and managed for tribal nations. Doing this started a chain of events that still effect nations today. Things like funding for Indian Health Services and other necessary funding can be withheld by the federal gov if they requirements.
So you want to give your land back..
Let’s say Joe Smith, a farmer from South Dakota decides he wants to give his 120 acres of land back to the Lakota Nation. Here’s how he could do it.
He would start by presenting to the Tribal Council at their next council meeting, showing his land, that he wants to return it to the Tribe, and would then sign over his land deed to the tribe.
He would still be able to live on his land, the tribe would not have access to it. He could still farm etc. The main difference would be that his land would now fall under tribal jurisdiction and not state. He would pay Tribal taxes on his property and not state tax. The details of this varies by nation so if this is appealing to you, ask!
The tribe would submit that transfer of land title to the federal gov., and then the government would add that land into their trust. This takes 1-5 years to finalize.
So when has this worked successfully ??

First of all, saying that there’s no way is ignorant because there IS a way to fix it, if only people knew about it publicly and breed clubs embraced it.
These are called Retro Mops (website here), and they’re pugs bred specifically to be longer-legged, leaner, with smaller eyes, longer muzzles, and more open nostrils. And while the project is still a work in progress, it’s heading in the right direction.
This new breed type started in Germany, and developed from the selective breeding of purebred pugs with longer muzzles and a longer legged frame.
From the website:
“We want to prove that a pug does not have to be short of breath and phlegmatic, but a very sporty and docile family and companion dog”
And there’s also a different strain of bulldog, which is a muscular and athletic tpe that can actually clean itself, mate, and give birth on its own (something that mainstream Bulldogs cannot do) (breeder here)
This should be the goal of EVERY pug breeder and owner, to have a healthy dog that doesn’t struggle to breathe and walk.
I’m sure you’re a pug or bulldog lover, which is why you’re so eager to defend them, but you’re not helping these dogs out by ignoring the problems in the breed. This is not a “little problem”, it’s a HUGE issue that’s killing dogs, and it’s prefectly preventable if pugs were outcrossed to have longer muzzles and wider nostrils.
Just look at the difference and tell me you’re not horrified:
As long as people stay blind to these issues, nothing will change. Which is why I’m saying this here so at least some people will see that there IS an alternative, and that wheezing pugs and bulldogs are not cute. When the public realizes the difference, the demand for these mutants will stop and more healthy, longer-lived alternatives will replace them.
But it starts with someone talking about them, and not just thinking there’s nothing to be done. Although if there were a time machine at my disposal you bet I’d use to pinch the nostrils of the original Victorian breeders and see how they like it.
As long as you give your pug a healthy diet and exercise, it will not be unhealthy. Pugs can live long happy, healthy lives. Instead of trying to promote killing off a breed, promote awareness that you /can not/ give pugs table scraps, they /need/ exercise regularly, and they need to be on a strict feeding schedule to stay healthy. If they are overweight, that’s when they encounter problems with their health and it makes it more difficult for them to catch their breath.
No one is telling people to kill off the breed, just drastically improve it so that the majority of the breed no longer has to have an operation to fix their terrible stenotic nares. You also reblogged my other post where I actually CLARIFY this, so it’s very clear you misunderstood the entirety of BOTH posts. It’s impossible for a pug to live a healthy, normal life given the state of its health issues, whether or not it’s being exercised. Unless that dog has wide nostrils and a longer muzzle. A pug doesn’t know what it’s like to live without being able to breathe propertly, so it’s not going to express it’s discomfort aside from grunting and wheezing. Pugs are all over your blog, and your title mentions them too. I get it. You love the breed. Okay. I’m sure your “three fit, healthy pugs” are well loved, but believing that diet and exercise will automatically fix a broken breed does so much harm to the dogs and all the efforts to improve them. Just because you have that specific breed doesn’t make you an expert, so please come back when your dog doesn’t have stenotic nares.
