and i don't mean this in a fanservice way i mean this in a “i find three versions of a story that are clearly in conversation and the final one asks a hopeful question" interesting way. maybe ill feel differently once stargaze is over and i can evaluate all three versions in their completion! who knows! but i would ask that people think about it more than just "it's completely different from trimax and that is bad"
i also really like the solarpunk turn for trigun. it started as a love letter to westerns, and then clear homage to classic scifi, and we thought it would go more grimdark cyberpunk. but instead we're getting a hopeful version of humanity's future. to me, that's really cool.

"AI psychosis" is one of those terms that is incredibly useful and also almost certainly going to be deprecated in smart circles in short order because it is: a) useful; b) easily colloquialized to describe related phenomena; and c) adjacent to medical issues, and there's a group of people who feel very strongly any metaphor that implicates human health is intrinsically stigmatizing and must be replaced with an awkward, lengthy phrase that no one can remember and only insiders understand.
So while we still can, let us revel in this useful term to talk about some very real pathologies in our world.
Formally, "AI psychosis" describes people who have delusions that are possibly induced, and definitely reinforced and magnified, by a chatbot. AI psychosis is clearly alarming for people whose loved ones fall prey to it, and it has been the subject of much press and popular attention, especially in the extreme cases where it has resulted in injury or death.
It's possible for AI psychosis to be both a new and alarming phenomenon and also to be on a continuum with existing phenomena. Paranoid delusions aren't new, of course. Take "Morgellons Disease," a psychosomatic belief that you have wires growing in your body, which causes sufferers to pick at their skin to the point of creating suppurating wounds. Morgellons emerged in the 2000s, but the name refers to a 17th-century case-report of a patient who suffered from a similar delusion:
Morgellons is both a 400 year old phenomenon and an internet pathology. How can that be? Because the internet makes it easier for people with sparsely distributed traits to locate one another, which is why the internet era is characterized by the coherence of people with formerly fringe characteristics into organized blocs, for better (gender minorities, #MeToo) and worse (Nazis).
Morgellons is rare, but if you suffer from it, it's easy for you to locate virtually every other person in the world with the same delusion and for all of you to reinforce and egg on your delusional beliefs.
Morgellons isn't the only delusion that the internet reinforces, of course. "Gang stalking delusion" is a belief in a shadowy gang of sadistic tormentors who sneak hidden messages into song lyrics and public signage and innuendo in overheard snatches of other people's conversations. It is an incredibly damaging delusion that ruins people's lives.
Gang stalking delusion isn't new, either – as with Morgellons, there are historical accounts of it going back centuries. But the internet supercharged gang stalking delusion by making it easy for GSD sufferers to find one another and reinforce one another's beliefs, helping each other spin elaborate explanations for why the relatives, therapists, and friends who try to help them are actually in on the conspiracy. The result is that GSD sufferers end up ever more isolated from people who are trying mightily to save them, and more connected to people who drive them to self-harm.
Enter chatbots. Ready access to eager-to-please LLMs at every hour of the day or night means that you don't even have to find a forum full of people with the same delusion as you, nor do you have to wait for a reply to your anguished message. The LLM is always there, ready to fire back a "yes-and" improv-style response that drives you deeper and deeper into delusion:
It's possible that there are delusions that are even more rare than GSD or Morgellons that AI is surfacing. Imagine if you were prone to fleeting delusional beliefs (and whomst amongst us hasn't experienced the bedrock certainty that we put something down right here, only to find it somewhere else and not have any idea how that happened?). Under normal circumstances, these cognitive misfires might be fleeting moments of discomfort, quickly forgotten. But if you are already habituated to asking a chatbot to explain things you don't understand, it might well yes-and you into an internally consistent, entirely wrong belief – that is, a delusion.
Think of how often you noticed "42" after reading Hitchhiker's Guide to the Galaxy, or how many times "6-7" crops up once you've experienced a baseline of exposure to adolescents. Now imagine that an obsequious tale-spinner was sitting at your elbow, helpfully noting these coincidences and fitting them into a folie-a-deux mystery play that projected a grand, paranoid narrative onto the world. Every bit of confirming evidence is lovingly cataloged, all disconfirming evidence is discounted or ignored. It's fully automated luxury QAnon – a self-baking conspiracy that harnesses an AI in service to driving you deeper and deeper into madness:
That's the original "AI psychosis" that the term was coined to describe. As Sam Cole notes in her excellent "How to Talk to Someone Experiencing 'AI Psychosis,'" mental health practitioners are not entirely comfortable with the "psychosis" label:
"Psychosis" here is best understood as an analogy, not a diagnosis, and, as already noted, there is a large cohort of very persistent people who make it their business to eradicate analogies that make reference to medical or health-related phenomena. But these analogies are very hard to kill, because they do useful work in connecting unfamiliar, novel phenomena with things we already understand.
It's true that these analogies can be stigmatizing, but they needn't be. As someone with an autoimmune disorder, I am not bothered by people who describe ICE as an autoimmune disorder in which antibodies attack the host, threatening its very life. I am capable of understanding "autoimmune disorder" as referring to both a literal, medical phenomenon; and a figurative, political one. I have never found myself confusing one for the other.
"AI psychosis" is one of those very useful analogies, and you can tell, because "AI psychosis" has found even more metaphorical uses, describing other bad beliefs about AI. Today, I want to talk about three of these AI psychoses, and how they relate to one another: the investor AI delusion, the boss AI delusion, and the critic AI delusion.
Let's start with the investors' delusion. AI started as an investment project from the usual suspects: venture capitalists, private wealth funds, and tech monopolists with large cash reserves and ready access to loans during the cheap credit bubble. These entities are accustomed to making large, long-shot bets, and they were extremely motivated to find new markets to grow into and take over.
Growing companies need to keep growing, but not because they have "the ideology of a tumor." Growing companies' imperative to keep growing isn't ideological at all – it's material. Growth companies' stock trade at a high multiple of their "price to earnings ratio" (PE ratio), which means that they can use their stock like money when buying other companies and hiring key employees.
But once those companies' growth slows down, investors revalue those shares at a much lower PE multiplier, which makes individual executives at the company (who are primarily paid in stock) personally much poorer, prompting their departure, while simultaneously kneecapping the company's ability to grow through acquisition and hiring, because a company with a falling share price has to buy things with cash, not stock. Companies can make more of their own stock on demand, simply by typing zeroes into a spreadsheet – but they can only get cash by convincing a customer, creditor or investor to part with some of their own:
Tech companies have absurdly large market shares – think of Google's 90% search dominance – and so they've spent 15+ years coming up with increasingly absurd gambits to convince investors that they will continue to grow by capturing other markets. At first, these companies claimed that they were on the verge of eating one another's lunches (Google would destroy Facebook with G+; Facebook would do the same to Youtube with the "pivot to video").
This has a real advantage in that one need not speculate about the potential value of Facebook's market – you only have to look at Facebook's quarterly reports. But the downside is that Facebook has its own ideas about whether Google is going to absorb its market, and they are prone to forcefully make the case that this won't happen.
After a few tumultuous years, tech giants switched to promoting growth via speculative new markets – metaverse, web3, crypto, blockchain, etc. Speculative new markets are speculative, and the weakness of that is that no one can say how big those markets might be. But that's also the strength of those markets, because if no one can say how big those markets might be, then who's to say that they won't be very big indeed?
There's a different advantage to confining your concerns to imaginary things: imaginary things don't exist, so they don't contest your public statements about them, nor do they make demands on you. Think of how the right concerns itself with imaginary children (unborn babies, children in Wayfair furniture; children in nonexistent pizza parlor basements, children undergoing gender confirmation surgery). These are very convenient children to advocate for, since, unlike real children (hungry children, children killed in the Gaza genocide, children whose parents have been kidnapped by ICE, children whom Matt Goetz and Donald Trump trafficked for sex, children in cages at the US border, trans kids driven to self-harm and suicide after being denied care), nonexistent children don't want anything from you and they never make public pronouncements about whether you have their best interests at heart.
But as the AI project has required larger and larger sums to keep the wheels spinning, the usual suspects have started to run out of money, and now AI hustlers are increasingly looking to tap public markets for capital. They want you to invest your pension savings in their growth narrative machine, and they're relying on the fact that you don't understand the technology to trick you into handing over your money.
There's a name for this: it's called the "Byzantine premium" – that's the premium that an investment opportunity attracts by being so complicated and weird that investors don't understand it, making them easy to trick:
AI is a terrible economic phenomenon. It has lost more money than any other project in human history – $600-700b and counting, with trillions more demanded by the likes of OpenAI's Sam Altman. AI's core assets – data centers and GPUs – last 2-3 years, though AI bosses insist on depreciating them over five years, which is unequivocal accounting fraud, a way to obscure the losses the companies are incurring. But it doesn't actually matter whether the assets need to be replaced every two years, every three years, or every five years, because all the AI companies combined are claiming no more than $60b/year in revenue (that number is grossly inflated). You can't reach the $700b break-even point at $60b/year in two years, three years, or five years.
Now, some exceptionally valuable technologies have attained profitability after an extraordinarily long period in which they lost money, like the web itself. But these turnaround stories all share a common trait: they had good "unit economics. Every new web user reduced the amount of money the web industry was losing. Every time a user logged onto the web, they made the industry more profitable. Every generation of web technology was more profitable than the last.
Contrast this with AI: every user – paid or unpaid – that an AI company signs up costs them money. Every time that user logs into a chatbot or enters a prompt, the company loses more money. The more a user uses an AI product, the more money that product loses. And each generation of AI tech loses more money than the generation that preceded it.
To make AI look like a good investment, AI bosses and their pitchmen have to come up with a story that somehow addresses this phenomenon. Part of that story relies on the Byzantine premium: "Sure, you don't understand AI, but why would all these smart people commit hundreds of billions of dollars to AI if they weren't confident that they would make a lot of money from it?" In other words, "A pile of shit this big must have a pony underneath it somewhere!"
This is a great narrative trick, because it turns losing money into a virtue. If you've convinced a mark that the upside of the project is a multiple of the capital committed to it, then the more money you're losing, the better the investment seems.
So this is the first AI psychosis: the idea that we should bet the world's economy on these highly combustible GPUs and data centers with terrible unit economics and no path to break-even, much less profitability.
Investors' AI psychosis is cross-fertilized by our second form of AI psychosis, which is the bosses' AI psychosis: bosses' bottomless passion for firing workers and replacing them with automation.
Bosses are easy marks for anything that lets them fire workers. After all, the ideal firm is one that charges infinity for its outputs (hence the market's passion for monopolies) and pays nothing for its inputs (e.g. "academic publishing").
This means that the fact that a chatbot can't do your job isn't nearly as important as the fact that an AI salesman can convince your boss to fire you and replace you with a chatbot that can't do your job. Bosses keep replacing humans with defective chatbots, with catastrophic consequences, like Amazon's cloud service crashing:
Bosses are haunted by the ego-shattering knowledge that they aren't in the driver's seat: if the boss doesn't show up for work, everything continues to operate just fine. If the workers all stay home, the business grinds to a halt. In their secret hearts, bosses know that they're not in the driver's seat – they're in the back seat, playing with a Fisher Price steering wheel. AI dangles the possibility of wiring that toy steering wheel directly into the drive-train, so that the company's products go directly from the boss's imagination to the public without the boss having to ask people who know how to do things to execute their cockamamie schemes:
This is a powerfully erotic proposition for bosses, the realization of the libidinal fantasy in which sky-high CEO salaries can be justified by the fact that everything that happens in the company is truly, directly attributable to the boss. Like the delusional person who can be led deeper and deeper into a fantasy world by a chatbot, a boss's delusion that they are worth thousands of times more than their workers makes them easy prey for a chatbot salesman that pushes them deeper and deeper into that delusion, until they bet the whole company on it.
Now we come to the third and final novel AI psychosis, the critics' psychosis, that AI is an abnormally terrible technology. This is a species of "criti-hype," which is when critics repeat the hyped-up claims of the companies they're targeting, but as criticism (think of all the people who believed and uncritically amplified the ad-tech industry's self-serving claims of being able to control our minds by "hacking our dopamine loops"):
AI is a normal technology. The people who made it, and the circumstances under which it was made, are normal. Its uses and abuses are normal. That doesn't make it good, but it does make it unexceptional:
The exceptional part of AI isn't the technology, it's the bubble. There's nothing about AI per se that makes it exceptionally prone to devouring our natural resources, or endangering our jobs, or abetting war crimes. That's all because of the bubble, and the bubble relies on the idea that AI is exceptional, not normal. Repeating and amplifying claims about AI's exceptionalism helps the AI companies, because they rely on exceptionalism to keep the capital flowing and the bubble inflating.
AI is a normal technology. It's normal for a technology to be invented by unlikable and immoral people and institutions. Not every technology is invented by a shitty person, but shitty people and institutions are well represented (and possibly disproportionately represented) in the history of technology. Charles Babbage invented the idea of general purpose computers as a way of improving labor control on slave plantations:
Ada Lovelace wasn't interested in making slavery more efficient, but neither was she driven by pure scientific inquiry. She invented programming to help her bet on the horses (it didn't work):

The silicon transistor was co-invented by William Shockley, one of history's great pieces of shit, a eugenicist who was committed to exterminating all non-white people that he never managed to ship a commercial product:
IBM built the tabulators for Auschwitz. HP were the Pentagon's go-to contractors for any tech project that was so dirty no one else would touch it. We only got Unix because Bell Labs committed so many antitrust violations that they weren't allowed to productize it themselves.
It's not exceptional for AI companies to have terrible, piece-of-shit founders. It's not exceptional for these companies to participate in war crimes. It's not exceptional for these founders to want to pauperize workers. It's not exceptional for these companies to lie about their products, bankrupt naive investors through stock swindles, and pitch themselves to investors as a way for capital to win the class war.
None of this means that AI companies are good, it just means that they are not exceptional. And because they aren't exceptional, the same dynamics that govern other technologies apply to AI companies' products. Their utility is a function of what they do, not who made them or how they were sold. The utility of AI products is based on whether people find ways to use them that make them happy – not whether the people who made those technologies are good people, or whether the funding for the technology was fraudulent, or whether other people use the technology to harm others.
Automation comes in two flavors: there's automation that produces things more quickly (and hence more cheaply), and there's automation that makes better things. Generally, capital prefers to use automation to increase the pace at which things are made, while workers prefer to use automation to improve the quality of the things they make.
Think of a hobbyist who pines for an automated soldering machine. That hobbyist longs to make board-level repairs and modifications that require precision that humans struggle to match. The hobbyist is a centaur, using a machine to help achieve human goals.
Now think of a factory owner who invests in an assembly line of the same machines: that boss wants to fire a bunch of workers and make the survivors of the purge take up the slack. The boss want to achieve corporate goals, to "sweat the assets," making maximum use of the soldering machines. The pace at which the line runs is set to be the maximum that the workers can match. The workers on the line are "reverse centaurs" – humans who are pressed into service as peripherals for machines, at a pace that is constantly at the very limit of their endurance.
Reverse centaurs are trapped in capital's automation plan – to make everything faster and cheaper. But that's the result of bosses. It's not the result of technology.
This is not to say that technology is apolitical. Only a fool would imagine that there are no politics embedded in technology. But you'd be a far greater fool if you asserted that the politics of a technology were simple, clear, and immutable.
Nor is this to say that when workers get to decide when and how to use technology, we will always make wise decisions. Perhaps the hobbyist who opts for an automated soldering machine will lose out on the opportunity to refine their hand-eye coordination in ways that will have many other benefits to their practice.
Or perhaps attempting to improve their hand-eye coordination to that point will wreck so many projects that they grow discouraged and give up altogether. Others' choices that seem unwise to you might have perfectly good explanations that aren't visible from your perspective. Ultimately, the world is a better place where workers get to decide which parts of their jobs they want to automate and which parts they want to lean into.
This is an extremely normal technological situation: for a new technology to be promoted and productized by shitty people who have grandiose goals that would be apocalyptic should they ever come to pass – and for some people to find uses of that technology that are nevertheless beneficial to them and their communities.
The belief that AI is an exceptionally bad technology (as opposed to an exceptionally bad economic bubble) drives AI critics into their own absurd culs-de-sac.
There are many, many skilled and reliable practitioners of technical and creative trades who've found extremely reasonable, normal ways in which AI has automated some part of their job. They aren't hyperventilating about how AI has changed everything forever and the world is about to end. They're not mistaking AI for god, or a therapist.
They're just treating AI like a normal technology, like a plugin. Programmers' tools have acquired useful automation plugins at regular intervals for decades – syntax checkers, advanced debuggers, automated wireframe utilities. For many programmers – including several of my acquaintance, whom I know to be both thoughtful and skilled – AI is another plugin, one they find useful enough to be modestly enthusiastic about.
It is nuts to deny the experiences these people are having. They're not vibe-coding mission-critical AWS modules. They're not generating tech debt at scale:
They're just adding another automation tool to a highly automated practice, and using it when it makes sense. Perhaps they won't always choose wisely, but that's normal too. There's plenty of ways that pre-AI automation tools for software development led programmers astray. A skilled, centaur-configured programmer learns from experience which automation tools they should trust, and under which circumstances, and guides themselves accordingly.
It's only the belief that AI is exceptional – exceptionally wicked, but exceptional nevertheless – that leads critics to decide that they are a better judge of whether a skilled worker should or should not use certain automation tools, and to make that judgment not based on the quality of the work in question, but on the moral character of the tool itself.
AI is just normal. The bubble is what drives the environmental costs. If the only LLMs were a couple big data-centers at Sandia National Labs, no one would be particularly exercised about the water and energy demands they represented. Big scientific endeavors – from NASA launches to the large Hadron Collider – often come with immense material and energy needs. The bubble causes massive, wasteful, duplicative efforts that chase diminishing returns through farcical scale.
Nor are AI bros exceptional. The stock swindlers who've blown $700b (and counting) on AI aren't cyber-Svengalis with the power to cloud investors' minds. They're just running the same con that tech has been running ever since its returns started to taper off and survival became a matter of ginning up enthusiasm for speculative new ventures.
That doesn't mean those people aren't awful shits. Fuck those people. It just means that they're normal awful shits. We don't have to burnish their reputations by elevating them to the status of archdemons who taint everything they touch with unwashable sin. Sam Altman isn't Lex Luthor. He's just a conman:
The fact that these bros are just normal assholes means that we don't have to treat everything they do as a sin. Scraping the entirety of human knowledge to make something new out of it isn't "stealing." Depending on why you're doing it, it can be archiving, or making a search engine:
Too many AI critics have started from the undeniable fact that these guys are odious creeps who boast about wanting to ruin the lives of workers and then worked backwards to find the sin. The sin isn't performing mathematical analysis on all the books ever written. That's actually kind of awesome. It's the kind of thing Aaron Swartz used to do – like when he ingested every law review article ever published and used it to trace the way that oil companies' donations to law schools resulted in profs writing articles about why Big Oil can't be held liable for trashing the planet:
AI bros' sin isn't making copies of published works. Hammering servers with badly behaved crawlers is a dick move and fuck them for doing it. But if these jerks made well-behaved scrapers that placed no abnormal demand on servers, it's not like their critics would say, "Oh, I guess it's fine, then."
AI bros' sin is running an economy-destroying, planet-wrecking stock swindle whose raison d'etre is pauperizing every worker and transferring 100% of the dying world's wealth to a small cadre of morbidly wealthy, eminently guillotineable plutes. Making plugins? That's not exceptional. It's just normal.
The fact that something is normal doesn't make it good. There's a lot of normal things that I'd like to throw into the Sun. But we don't do ourselves any favors when we amplify our enemies' self-aggrandizing narratives by accusing them of being exceptional, even when we mean "exceptionally evil." They're normal assholes.

What if there was a way for a business to transform any conduct it disliked into a felony, harnessing the power of the state to threaten anyone who acted in a way that displeased the company with a long prison sentence and six-figure fines?
Surprise! That actually exists! It's called Section 1201 of the Digital Millennium Copyright Act, the "anticircumvention" clause, which establishes five-year sentences and $500k fines for anyone who bypasses an "effective access control" for a copyrighted work.
Let's unpack that: every digital product has a "copyrighted work" at its core, because software is copyrighted. Digital systems are intrinsically very flexible: just overwrite, augment, or delete part of the software that powers the device or product, and you change how the product works. You can alter your browser to block ads; or alter your Android phone to run a privacy-respecting OS like Graphene; or alter your printer to accept generic ink, rather than checking each cartridge to confirm that it's the original manufacturer's product.
However, if the device is designed to prevent this – if it has an "access control" that restricts your ability to change the software – then DMCA 1201 makes those modifications into crimes. The act of providing someone with a tool to change how their own property works ("trafficking in circumvention devices") is a felony.
But there's a tiny saving grace here: for DMCA 1201 to kick in, the "access control" must be "effective." What's "effective?" There's the rub: no one knows.
The penalties for getting crosswise with DMCA 1201 are so grotendous that very few people have tried to litigate any of its contours. Whenever the issue comes up, defendants settle, or fold, or disappear. Despite the fact that DMCA 1201 has been with us for more than a quarter of a century, and despite the fact that the activities it restricts are so far-reaching, there's precious little case law clarifying Congress's vague statutory language.
When it comes to "effectiveness" in access controls, the jurisprudence is especially thin. As far as I know, there's just one case that addressed the issue, and boy was it a weird one. Back in 2000, a "colorful" guy named Johnny Deep founded a Napster-alike service that piggybacked on the AOL Instant Messenger network. He called his service "Aimster." When AOL threatened him with a trademark suit, he claimed that Aimster was his daughter Amiee's AOL handle, and that the service was named for her. Then he changed the service's name to Madster, claiming that it was also named after his daughter. At the time, a lot of people assumed he was BSing, but I just found his obituary and it turns out his daughter's name was, indeed, "Amiee (Madeline) Deep":
Aimster was one of the many services that the record industry tried to shut down, both by filing suit against the company and by flooding it with takedown notices demanding that individual tracks be removed. Deep responded by "encoding" all of the track names on his network in pig-Latin. Then he claimed that by "decoding" the files (by moving the last letter of the track name to the first position), the record industry was "bypassing an effective access control for a copyrighted work" and thus violating DMCA 1201:
The court didn't buy this. The judge ruled that pig Latin isn't an "effective access control." Since then, we've known that at least some access controls aren't "effective" but we haven't had any clarity on where "effectiveness" starts. After all, there's a certain circularity to the whole idea of "effective" access controls: if a rival engineer can figure out how to get around an access control, can we really call it "effective?" Surely, the fact that someone figured out how to circumvent your access control is proof that it's not effective (at least when it comes to that person).
All this may strike you as weird inside baseball, and that's not entirely wrong, but there's one unresolved "effectiveness" question that has some very high stakes indeed: is Youtube's javascript-based obfuscation an "effective access control?"
Youtube, of course, is the internet's monopoly video platform, with a commanding majority of video streams. It was acquired by Google in 2006 for $1.65b. At the time, the service was hemorrhaging money and mired in brutal litigation, but it had one virtue that made it worth nine figures: people liked it. Specifically, people liked it in a way they didn't like Google Video, which was one of the many, many, many failed internally developed Google products that tanked, and was replaced by a product developed by a company that Google bought, because Google sucks at developing products. They're not Willy Wonka's idea factory – they're Rich Uncle Pennybags, buying up other kids' toys:
Google operationalized Youtube and built it up to the world's most structurally important video platform. Along the way, Google added some javascript that was intended to block people from "downloading" its videos. I put "downloading" in scare-quotes because "streaming" is a consensus hallucination: there is no way for your computer to display a video that resides on a distant server without downloading it – the internet is not made up of a cunning series of paper-towel rolls and mirrors that convey photons to your screen without sending you the bits that make up the file. "Streaming" is just "downloading" with the "save file" button removed.
In this case, the "save file" button is removed by some javascript on every Youtube page. This isn't hard to bypass: there are dozens of "stream-ripping" sites that let you save any video that's accessible on Youtube. I use these all the time – indeed, I used one last week to gank the video of my speech in Ottawa so I could upload it to my own Youtube channel:
Now, all of this violates Youtube's terms of service, which means that someone who downloads a stream for an otherwise lawful purpose (like I did) is still hypothetically at risk of being punished by Google. We're relying on Google to be reasonable about all this, which, admittedly, isn't the best bet, historically. But at least the field of people who can attack us is limited to this one company.
That's good, because there's zillions of people who rely on stream-rippers, and many of them are Youtube's most popular creators. Youtube singlehandedly revived the form of the "video essay," popularizing it in many guises, from "reaction videos" to full-fledged, in-depth documentaries that make extensive use of clips to illuminate, dispute, and expand on the messages of other Youtube videos.
These kinds of videos are allowed under US copyright law. American copyright law has a broad set of limitation and exceptions, which include "fair use," an expansive set of affirmative rights to access and use copyrighted works, even against the wishes of the copyright's proprietor. As the Supreme Court stated in Eldred, the only way copyright (a government-backed restriction on who can say certain words) can be reconciled with the First Amendment (a ban on government restrictions on speech) is through fair use, the "escape valve" for free expression embedded in copyright:

Which is to say that including clips from a video you're criticizing in your own video is canonical fair use. What else is fair use? Well, it's "fact intensive," which is a lawyer's way of saying, "it depends." One thing that is 100% true, though, is that fair use is not limited to the "four factors" enumerated in the statute and anyone who claims otherwise has no idea what they're talking about and can be safely ignored:
Now, fair use or not, there are plenty of people who get angry about their videos being clipped for critical treatment in other videos, because lots of people hate being criticized. This is precisely why fair use exists: if you had to secure someone's permission before you were allowed to criticize them, critical speech would be limited to takedowns of stoics and masochists.
This means that the subjects of video essays can't rely on copyright to silence their critics. They also can't use the fact that those critics violated Youtube's terms of service by clipping their videos, because only Youtube has standing to ask a court to uphold its terms of service, and Youtube has (wisely) steered clear of embroiling itself in fights between critics and the people they criticize.
But that hasn't stopped the subjects of criticism from seeking legal avenues to silence their critics. In a case called Cordova v. Huneault, the proprietor of "Denver Metro Audits" is suing the proprietor of "Frauditor Troll Channel" for clipping the former's videos for "reaction videos."
One of the plaintiff's claims here is that the defendant violated Section 1201 of the DMCA by saving videos from Youtube. They argue that Youtube's javascript obfuscator (a "rolling cipher") is an "effective access control" under the statute. Magistrate Judge Virginia K DeMarchi (Northern District of California) agreed with the plaintiff:
Remember, DMCA 1201 applies whether or not you infringe someone's copyright. It is a blanket prohibition on the circumvention of any "effective access control" for any copyrighted work, even when no one's rights are being violated. It's a way to transform otherwise lawful conduct into a felony. It's what Jay Freeman calls "Felony contempt of business model."
If the higher court upholds this magistrate judge's ruling, then all clipping becomes a crime, and the subjects of criticism will have a ready tool to silence any critic. This obliterates fair use, wipes it off the statute-book. It welds shut copyright's escape valve for free expression.
Now, it's true that the US Copyright Office holds hearings every three years where it grants exemptions to DMCA 1201, and it has indeed granted an exemption for ripping video for critical and educational purposes. But this process is deceptive! The exemptions that the Copyright Office grants are "use exemptions" – they allow you to "make the use." However, they are not "tools exemptions" – they do not give you permission to acquire or share the tool needed to make the use:
Which means that you are allowed to rip a stream, but you're not allowed to use a stream-ripping service. If Youtube's rolling cipher is an "effective access control" then all of those stream-ripping services are wildly illegal, felonies carrying a five-year sentence and a $500k fine for a first offense under DMCA 1201.
Under the US Copyright Office's exemption process, if you want to make a reaction video, then you, personally must create your own stream-ripper. You are not allowed to discuss how to do this with anyone else, and you can't share your stream-ripper with anyone else, and if you do, you've committed a felony.
So this is a catastrophic ruling. If it stands, it will make the production of video essays, reaction videos, and other critical videos into a legal minefield, by giving everyone whose video is clipped and criticized a means to threaten their critics with long prison sentences, fair use be damned. The only people who will safely be able to make this kind of critical video are skilled programmers who can personally defeat Youtube's "rolling cipher." And unlike claims about stream-ripping violating Youtube's terms of service – which can only be brought by Youtube – DMCA 1201 claims can be brought by anyone whose videos get clipped and criticized.
Is Youtube's rolling cipher an "effective access control?" Well, I don't know how to bypass it, but there are dozens of services that have independently figured out how to get around it. That seems like good evidence that the access control is not "effective."
When the DMCA was enacted in 1998, this is exactly the kind of thing experts warned would happen:
And here we are, more than a quarter-century later, living in the prison of lawmakers' reckless disregard for evidence and expertise, a world where criticism can be converted into a felony. It's long past time we get rid of this stupid, stupid law:

Crafting A Fantasy Culture, or the fallacies of using culture in the singular
The world is an interdependent place.
A lot of Western writers will look at the need to diversify their writing and try to cherry pick outside cultures to add. They then come to us with a laundry list of questions about what they’re allowed to change about those cultures because, well, they didn’t pull from a broad enough context.
The thing about researching individual cultures is: you’re never going to be researching just one culture. You’re going to be researching all the cultures they interacted with, as well.
Cultures are made by interacting with other cultures. So you can’t simply plop a singular culture into a fantasy world and expect it to work. There is too much outside influence on that culture for you to get a holistic picture by researching the culture in isolation.
Instead, you need to ask yourself, “what environments made them, and how much of their surrounding contexts do I need to add to my fantasy world to make this genuine respectful representation?”
And before you say that you can’t possibly do that, that is too much research, let me introduce you to the place you’re already doing it but don’t realize:

Aka, fantasy Europe.
It gets ragged on a lot, but let’s take a minute to look at the tropes that build this stock fantasy world.

Sheep
Knights
A king
Farming based economy
Religion plays a pretty big role in life
All fairly generic fantasy Europe tropes. But if you look more closely, you’ll notice that this is painting a picture of Fantasy Germany/the Netherlands, with perhaps a dash of France and/or England in there, all of it vaguely Americanized (specifically the New England area) because there’s usually potatoes and tomatoes. The geographic region is pretty tight, and it just so happens to mesh with the top three superpowers of upper North America, and arguably the English speaking world.
But let’s keep going.
They import stuff. Like fine cloth, especially silk, along with dyes & pigments
These things are expensive from being imported, so the nobility mostly have them
There’s usually a war-mongering Northern People invading places
If brown people exist they are usually to the East
There might be a roaming band of nomadic invaders who keep threatening things
There is, notably, almost no tropical weather, and that is always to the South if it’s mentioned
There might be an ocean in the South that leads to a forgien land of robed people to survive a desert (or did I just read too much Tamora Pierce?)
And, whoops, we have just accidentally recreated European history in its full context.
The Northern people are Norse, and their warring ways are indicative of the Viking Invasion. The imports hint at Asia, namely the Ottomans and India, and the silk road. The roaming invaders are for Mongolian Khanate. The ocean and tropical weather in the South hints at Spain, Greece, and the Mediterranean. And the continent of robed people indicates North Africa, and/or Southwest Asia.
Suddenly, stock fantasy world 29 has managed to broad-strokes paint multiple thousands of years of cultural exchange, trade, wars, invasions, and general history into a very small handful of cultural artifacts that make up throwaway lines.
Europe As Mythology And You
European history is what’s taught in Western classrooms. And a lot of European history is painted as Europe being a cultural hub, because other places in the world just aren’t talked about in detail—or with any sort of context. Greece and Rome were whitewashed; the Persian and Ottoman empires were demonized; North Africans became the enemy because of their invasion of Spain and the fact many of them were not-Christian; the Mongolian Khanate was a terrible, bloodthirsty culture whose only goal was destruction.
But because all of these parts did interact with Europe and were taught in history class, writers crafting a fantasy Europe will automatically pull from this history on a conscious or subconscious level because “it’s what makes sense.”
The thing is, despite people writing European fantasy subconsciously recreating European history, they don’t actually recreate historical reality. They recreate the flattened, politically-driven, European-supremacist propaganda that treats every culture outside of Europe as an extra in a movie that simply exists to support Europe “history” that gets taught in schools.
As a result of incomplete education, a lot of people walk away from history class and believe that cultures can be created in a vacuum. Because that’s the way Europe’s history was taught to them.
Which leads to: the problem with Fantasy World 29 isn’t “it’s Europe.” It’s the fact it’s an ahistorical figment of a deeply colonial imagination that is trying to justify its own existence. It’s homogeneous, it only mentions the broader cultural context as a footnote, it absolutely does not talk about any people of colour, and there’s next to no detailing of the variety of people who actually made up Europe.
So writers build their Fantasy World 29 but they neglect the diversity of religion and skin tone and culture because it’s unfamiliar to them, and it was never taught to them as a possibility for history.
While “globalization” is a buzzword people throw around a lot to describe the modern age, society has been global for a large portion of human history. There were Japanese people in Spain in the 1600s. Polynesians made it to North America decades if not centuries before Columbus did. There are hundreds more examples like this.
You can absolutely use fantasy to richen your understanding of Europe, instead of perpetuating the narratives that were passed down from victor’s history. People of colour have always existed in Europe, no matter what time period you’re looking at, and unlearning white supremacist ideas about Europe is its own kind of diversity revolution.
Travel is Old and People Did It Plenty
Multiculturalism is a tale as old as time. And while some populations were very assimilationist in their rhetoric, others were very much not. They would expand borders and respect the pre-existing populations, or they would open up networks to outsiders to become hubs of all the best the world had to offer. Even without conscious effort, any given place was building off of centuries of human migration because humans covered the globe by wandering around, and people have always been people.
Regardless, any time you have a group of people actively maintaining an area, they want to make travelling for themselves easier. And the thing about making travelling for yourself easier is: it made travel for outsiders just as possible. By the time you reach the 1200s, even, road, river, and ocean trade networks were thriving.
Sure, you might be gone for a year or three or five because the methods were slow, but you would travel. Pilgrimages, trade routes, and bureaucratic administrative routes made it possible for people to move around.
And also, soldiers and war did really good jobs of moving people around, and not all of them went back “home.” Hence why there have been African people in England since the Roman empire. When you have an empire, you are going to take soldiers from all over that empire; you aren’t going to necessarily pull from just the geographic region immediately surrounding the capital.
Yes, the population that could travel was smaller than it is now, because land needed to be worked. But Europe isn’t the be all end all in how much of its population needed to be in agriculture in order to function; the Mughals, for example, had 80% of their population farming, compared to over 90% for Europe in the same time period. That’s an extra 10% of people who were more socially free to move around, away from their land. Different cultures had different percentages of people able to travel.
This isn’t counting nomadic populations that relied on pastoralism and horticulture who didn’t actually settle down, something a lot of history tends to ignore because cities are easier to discuss. But nomadic populations existed en masse across Eurasia, and they took cultural traditions all over the continent.
Just because it wasn’t fast doesn’t mean it didn’t happen. And just because a lot of Europeans couldn’t travel because of the agricultural demands of the continent, doesn’t mean every other culture was as tied to settlements.
Multiculturalism and Diffusion
While each individual culture is unique, and you can find pockets of difference anywhere, cultures exist on a sliding scale of broad customs across the globe. Greece and Turkey will have more in common than China and England, because the trade routes were much closer and they shared central rulership for multiple hundreds of years.
This is why we keep saying it’s important to keep cultures with other cultures close to them. Because those are the natural clusters of how all of the cultures involved would be formed. The proper term for this is cultural diffusion, and it happened all the time. Yes, you could get lots of people who had their own unique customs to set themselves apart. But they had the same natural resources as the dominant group, which meant they couldn’t be completely and totally alien.
Even trade influence wouldn’t produce the same results in two places. When Rome imported silks from China, they rewove them to be a different type of fabric that was lighter and more suited to their climate. Then the Romans sold the rewoven silk back to China, who treated it differently because they’d woven it the first way for a reason. They didn’t talk to each other directly because of how the Silk Road was set up at the time, either, so all they had were the goods.
And people automatically, subconsciously realize this whenever they write Fantasy World 29. They put like cultures with like cultures in Europe. Because even if they weren’t really taught to see the rest of the world as anything more than a footnote, they still transfer those footnotes to their fantasy.
The problem is, people don’t realize the gradient of customs. In the modern day, Greece and Turkey are different countries, with histories that are taught in totally different frameworks (Greece as an appropriated white supremacist “ancient land” that all Western European societies are descendent from, Turkey as a land of brown people that were Muslim and therefore against the Good Christian Europe), so it’s really easy to ignore all of their shared history.
People often fought for the right to rule (or even exist) in a place, which deeply impacted the everyday people and government. Ancient Persia is a fantastic example of this, because it covered huge swaths of land and was a genuinely respectful country (it took over a deeply disrespectful country); had it not been for Cyrus the Great deciding that he would respect multiculturalism, the Second Temple wouldn’t have been rebuilt in Jerusalem.
You can’t homogenize an area that was never homogenous to begin with. Because there was a ton of fighting and sometimes centuries-old efforts to preserve culture in the face of all this fighting (that sometimes came with assimilation pressure). Dominant groups, invading groups, influencing groups, and marginalized groups have always existed in any given population. See: Travel is Old above. See: people have always been people and wandered around. Xenophobia is far, far older than racism ever will be, because xenophobia is simply “dislike of Other” and humans love crafting “us vs them” dynamics.
This lack of unity matters. It’s what allows you to look at a society (especially one with a centralized government) and see that it is made up of people that are different. It leads you to asking questions such as:
Who was persecuted by this group?
Did the disliked group of people exist within their borders, or were they driven away and are now enemy #1?
What was their mindset on diversity?
How did they handle others encroaching on what they saw as their territory?
People do different things across different households, let alone hundreds of miles away. You wouldn’t expect someone from a rich, white area of California to behave the same way as someone from a middle-class immigrant neighbourhood from NYC. I’m sure, if you looked at your own city, you would scoff at the concept of someone mistaking your city for one five hours away, because when you know them, they’re so different.
So why do you expect there to be only one type of person anywhere else?
Cultural and Geographic Context Matters
A region’s overreacting culture (either determined by groups of people who mostly roam the land, or a centralized government) and their marginalized cultures determine the infighting within a group, even if the borders remain the same.
Persecution and discrimination are just as contextual as culture. Even if the end result of assimilation and colonialism was the same, the expectations for assimilation would look different, and what they had been working with before would also look different. You can’t compare Jewish exile from various places in Europe with Rromani exiles in Europe, and you definitely can’t compare them with the Hmong in Southeast Asia. They came from different places and were shaped by different cultures.
A culture that came from a society that hated one particular aspect of them will not form—at all—if they’re placed in a dominant culture that doesn’t find their cultural norms all that persecution-worthy. And the way they were forced to assimilate to survive will play into whatever time period you’re dealing with, as well; see the divide of Jewish people into multiple categories, all shaped by the resources available in the cultures they stayed in the longest.
You can’t remove a culture’s context and expect to get the same result. Even in a culture that doesn’t wholesale have an assimilationist agenda, you can still get specific prejudices and scapegoats that happen when there’s a historical precedent in the region for disliking a certain group.
Once you start cherry picking what elements of a culture to take—because you’ve plunked the !Kung into Greece and need to modify their customs from the desert to a tropical destination —you’re going to end up with coding that is absolutely positively not going to land.
Coding is a complex combination of foods, clothing, behaviour/mannerisms, homes, beliefs, and sometimes skin tone and facial features. A properly coded culture shouldn’t really need any physical description of the people involved in order to register as that culture. So when you remove the source of food, clothing, and home-building materials… how can you code something accurately from that?
And yes, it’s intimidating to think of doing so much research and starting from 0. You have to code a much larger culture than you’d originally intended, and it absolutely increases the amount of work you have to do.

Takeaways
Writers need to be aware of diversity not just as a nebulous concept, but as something that simply exists and has always existed. And the diversity (or lack thereof) of any one region is a result of, specifically, the politics of that region.
Diversity didn’t just exist “over there”. It has always existed within a society. Any society. All societies. If you want to start adding diversity into your fantasy, you should start looking at the edges of Fantasy World 29 and realize that the brown people aren’t just stopping at the designated border and trading goods at exactly that spot, but have been travelling to the heart of the place for probably a few hundred years and quite a few of them probably liked the weather, or politics, better so they’ve settled.
Each society will produce a unique history of oppressing The Other, and you can’t just grab random group A and put it in societal context B and expect them to look the same. Just look at the difference between the Ainu people, the anti-Indigenous discrimination they face, and compare it to how the Maori are treated in New Zealand and the history of colonialism there. Both Indigenous peoples in colonial societies on islands, totally different contexts, totally different results.
If random group A is a group marked by oppression, then it absolutely needs to stay in its same societal context to be respectful. If random group A is, however, either not marked by being oppressed within its societal context and/or is a group that has historically made that move so you can see how their situation changed with that move, then it is a much safer group to use for your diversity.
Re-learn European history from a diverse lens to see how Europe interacted with Africa and Asia to stop making the not-Europe parts of Fantasy World 29 just be bit parts that add flavour text but instead vibrant parts of the community.
Stop picking singular cultures just because they fascinate you, and place them in their contexts so you can be respectful.
