Portugal recently introduced three consecutive days of employer-paid leave per month for employees who experience severe and disabling menstrual pain caused by endometriosis or adenomyosis. This change took effect on 26 April 2025.

Background

Law 32/2025 aims to promote the rights of individuals with endometriosis or adenomyosis by strengthening access to healthcare and creating a new entitlement of justified absences from work.

In 2023, Spain became the first European country to introduce leave for female employees who suffer severe menstrual pain, including pain due to conditions such as endometriosis or polycystic ovaries (see previous Lockton article here (opens a new window)). While the new entitlement in Portugal is more limited and only applies to employees who have been diagnosed specifically with endometriosis or adenomyosis, it represents a significant step in the region towards raising awareness and providing support for individuals affected by painful or disruptive menstrual symptoms.

Key details

Employees who experience severe and disabling pain caused by endometriosis or adenomyosis during their menstrual period are entitled to paid leave for up to three consecutive days per month of work (i.e., up to 36 days per year). This leave is fully paid by the employer.

To be eligible for this leave, the employee must provide the employer with a medical certificate confirming a diagnosis of endometriosis or adenomyosis accompanied by debilitating pain. This certificate is only required when the leave is initially taken and does not need to be renewed.

Under Law 32/2025, new rules and guidelines are expected to be introduced by the National Health Service (NHS) by 25 June 2025 to ensure universal healthcare coverage for all Portuguese citizens and residents affected by endometriosis or adenomyosis accompanied with severe and disabling pain. These guidelines will outline the symptoms to monitor, available diagnostic tests and procedures, and recommended follow-up care.

The law also mandates the establishment of a co-payment scheme for medications prescribed by NHS specialist doctors to treat or manage symptoms associated with these conditions.

In addition, individuals diagnosed with endometriosis or adenomyosis will be entitled to access fertility preservation services through the NHS, including the collection and storage of oocytes (egg cells)."

Robby could tell you were in pain today. The way you winced as you walked and held your hand flat over your abdomen trying to generate heat. You looked pale and exhausted. You had talked to him before about your diagnosis of adenomyosis, as a man he wasn’t really sure what to say.

He hated seeing you in pain. You’re a brilliant nurse practitioner and you truly work hard with Dana to keep this place running as perfect as you can. Above all that? He may or may not be slightly sweet on you, not that he would admit.

You walk past Robby in your grey scrubs, smiling sadly at him, trying to grin and bear it. In a moment of weakness, Robby watches your hips swish as you walk past and he sees it instantly. A big blood stain on the butt of your scrubs.

“Hey, Ace…you got a sec?” He asks, following you closely; trying to hide the stain without seeming too obvious.

“Yep…I’ve got 3 seconds for you, boss” you say with a soft smile. He leads you to the locker room and smiles sweetly at you.

“What’s up?” You ask, holding back a deep yawn, exhausted from the heavy bleeding.

“Sweetheart, you’ve bled through your scrubs. I have sweats in my locker you can change into…Let me know your size, I’ll go grab you a new pair of bottoms from the scrub machine” he says with no awkwardness or humiliation.

Your face burns bright red. “Wait…what?” You stay to try to look over your shoulder to see, even though you know it would be physically impossible. “Oh my god how fucking embarrassing…I haven’t done this shit since high school”

Robby hands you his dark grey sweats from his locker. “I know I don’t have any right…but this isn’t anything to be embarrassed about, honey” - again with the cute pet name? - “we’re all providers here…we’ve all seen everything you can see”

You nod in agreement but he can tell you’re not fully convinced. “Can you turn around?” You ask his softly and he immediately turns to face the wall. You quickly take off the offending garment and tug on Robby’s sweats.

He’s a thicker, broader man, but he’s still lithe. Your body is…softer…rounder…curvier. The sweats fit but they stretch over your thighs and hug your ass closely.

“Ok…here.” You say sheepishly, handing the pants towards Robby making sure the blood spot is tucked in the fold.

He turns around and makes a noise like the air just got pushed out of his lungs. Seeing his sweats splayed over your thick thighs and wide hips was not something he was expecting. “They fit good” he grumbles out before he can stop himself.

You blush, dropping your eyes.

He reaches forward and takes the scrub pants, knowing you have to exchange to get a new pair. “I’ll uh…be right back. Just don’t move”

He’s back in a couple minutes with a fresh pair of pants and a couple towels. “Here…if you wanted to jump in the shower?”

You gladly take the towels from him and smile gratefully at him. “Thank you, Robby. You really didn’t have to do all this”

“Nonsense, doll…I know you go through a lot with your diagnosis. It’s the least i could do…can’t stand the thought of you being uncomfortable or in pain” he admits, rubbing the back of his neck in an awkward form of self support.

“Well…then…thank you again, pumpkin” you say back playfully. He chuckles and finally exits the locker room giving you privacy.

The next morning Robby walks in to the ED and plops down at his usually computer station. On the desk are his sweats, clean and folded-smelling like your detergent-and a freshly brewed, still steaming cup of Starbucks coffee with a note.

Thank you for yesterday, Michael, you’re special, ya know that? You make it hard for me to stay professional…………..

Anyway.

I know you didn’t have time to stop this morning…coffee is the least I could do.

My dog somehow still has fleas. We gave him a 3rd treatment last week and they’re still crawling around super lively on him. Saw as many as 3 today. Please pray for him, we’re doing everything we can to help with the infestation but nothing seems to be working.
