India is a beautiful country with equity and equality, this is what I learnt through books but in real life it is not.
India has a lot of corruption, gender inequality and dirty politics.
Now, I would be talking about gender inequality. In India, only heterogenous men has the upper hand and, rest sex and sexuality are under their foots. The Indian government has took many steps to empower some sects of oppressed sex and sexuality, for an example, reservation in Gram Panchayat(Local body) for the women, reservation for women in competitive exams, special security forces and etc.. but still women are oppressed because of the patriarchy and social stigmas. Comparing to other sexes and sexuality, the women are empowered and safe even though India has high rate of women being raped, dowry murder, forced marriage etc...still, they are better than the unsaid pain suffered by the other sexes and sexuality. As, I am not a woman; I don't know their pain and can't express their thoughts and pain-they suffered but I can express the pain of queer community.
They are many cases in India where several queer community members are raped, bullied, forced into marriage and discriminated.
The Delhi Hight Court decriminalized the consensual same-sex in 2009 by several decades of fighting fulfilled the dreams of several centuries but still at many places people thought it was crime and forbade from anal intimacy. In 2013, the Supreme Court of India reversed the decision in order to protect male and transgender rapes but the most reason was to bring so called "Natural order " influenced by several religions, this lead the queer community to fight again and finally in 2018, the Supreme Court decriminalized the Section 377.
After this victory too, the queer community had and has to face social stigma and labels of "Haram", "demon" from the religious communities.
The Supreme Court of India rejected the idea of marriage of queer as it is not a fundamental right then I want to ask what about our other rights like right to equality?
We, queer are often discriminated and bullied. Almost all the households in India see us as a parasite to their so called " Natural Society by god's order." When people want to abuse and scold a stranger or friend they use the words 'Gay', 'Chakka', and Still, there are many transgenders refused to be employed due to their identity and Homosexuals fired or differentiated in work and many more. For them, we are the most awful category and when we come out with our sexuality, we are discriminated and outcasted from the society and has the Court has taken any actions for it? the answer is No.
There is not punishment for queerphobia in India. In fact, even the officials and assembly men use it, and encourage the discrimination and discriminate us but now, there is huge active activists trying and fighting their best to bring this down , even the media supports it from behind the screens. I wish as the time moves forward, the discrimination should end and the queer flag and women flag are safe under the Indian Flag and wish the legislature to bring new ideas to end this discrimination.
In final verdict, India is more safe for women than queer but not safer than heterogenous men. Both the queer community and the women has to rise their voice for their rights in India, and may be this can bring further change and improve the improving India in the matters of Sex and Sexual orientation discrimination.
India still needs to fight to be completely safe for Women and Queer community ,and I wish it can bring equality like Thailand and Taiwan.
