Verificando que a acusação estava baseada em razoável suporte probatório, dando conta da existência da infração penal descrita e fortes indícios de autoria, havendo justa causa para a ação penal, a 7ª Vara Criminal Federal de São Paulo recebeu denúncia oferecida pelo Ministério Público Federal contra acusado de hackear o sistema do tribunal. Na denúncia são imputados ao acusado o crime de invasão de dispositivo informático (artigo 154-A, caput, do Código Penal), em concurso material com o crime de falsificação de documento público (artigo 297, caput, do CP), este último por 8 vezes em continuidade delitiva. Consta da denúncia que, nos meses de janeiro e fevereiro de 2021, o acusado e um comparsa promoveram ataques cibernéticos ao sistema de processo eletrônicos da Justiça Federal da 3ª Região, com o propósito de alterar documentos eletrônicos com assinatura de agentes públicos, para obter vantagens pessoais. Em um processo da 22ª Vara Cível Federal de São Paulo, que   constitui execução de um banco contra a União, verificou-se que foi feita alteração na minuta que tratava do levantamento de valor, a fim que fosse assinada pelo juiz federal dos autos. O documento indicava a transferência de R$ 225.914 para uma conta de titularidade de um comparsa do acusado.
