Ok I watched The Trial of the Flash like, a couple days ago, and the case against him was so fucking shoddy I have to rant about it
(And btw I know he had to lose for plot reasons, and I'm not complaining cause I'm 1 episode into the prison arc and loving it. But still, in a fair trial, no way he's getting convicted)
First of all, at no point in the trial did they call any kind of character witness. Seriously??? Nothing good was said about Barry whatsoever! Not even an attempt to make him seem like a good, human person???
Now for this next bit I know he didn't want anyone to perjure themselves, but a) you know they would have done it whether he let them or not, and b) THEY DIDNT NEED TO, like at most they needed to bend the truth by a few minutes.
Ok I've put a lot of thought into this - supposedly DeVoe left his house alone, travelled to Barry's place, knocked on the door. Barry was there, let him in (for some reason, wouldn't he be risking the restraining order? Which by all civilian accounts he respected?), they had a conversation which escalated to a fight, and Barry stabs him. The security alarm goes off, Barry just stands there, doesn't clean up any fingerprints, and gives himself up.
Many ridiculous things here - number 1 being the timeline. Barry is ironically saved by adherence to the laws of Physics - since 5 different witnesses can place him at the West House for the preceeding hours, how could Barry possibly have gotten there to let DeVoe in? Sure, to avoid exposing the secret they could say he left in time to kill him, but that doesn't explain how DeVoe ended up inside the apartment. The alarm going off indicates an intruder of some kind, unless Barry set that up v
Also is Barry an evil genius or panicked? The prosecution tries to paint him as an obsessive psycho, but he couldn't premeditate this since he didn't know DeVoe would come. He couldn't have set anything up, but then again as an intelligent CSI, why wouldn't he clear up any evidence?
Finally, I don't know if they got another CSI, I should hope so cause otherwise that's unfair. But the forensic evidence shouldn't match either. When he picks up the knife when they receive it, he doesn't pick it up in a stabbing motion, he holds it gently from the side - and I'd presume that fingerprints and blood patterns would not match up.
My final point is I'm pretty sure true, but we don't get the best shot of the crime scene, so maybe it isn't. But if we're going off of what we can see in the episode-
Where is the wheelchair???
There's no wheelchair. DeVoe is lying straight on the ground, as though fallen from standing. The wheelchair isn't present, so how could DeVoe have been by that chain of events??
So neither Barry nor DeVoe could have participated in this 'argument' that supposedly took place, the evidence is circumstantial and Barry is not a murderer- ergo, he was framed.
So yeah, he should not have gone to jail there, and at the very least it should not have been such an open and shut case against him
(Will def be back to add my thoughts when they find a way to get him our, apparently there's absolutely nothing to prove his innocence which tells me they're not trying)
