The uncle theory would just be so tiring and honestly very tone deaf in terms of racial issues ESPECIALLY when there's so many more interesting ideas that they could do:

#2: Something to do with the case that they worked in 9x14. The lights were off in that show down and who knows who was "witnessing" that. Then there's also some questions about the girl's brother-- and the fact that while the bonding of real families Kim and her did could just be to underline the theme of the episode it could also be hinting to something deeper.
My final and favourite theory will have two points to it, that can co exist together but also could be two separate theories on their own, just as a preface.
#1: Makayla's biological father. Yeah he's in prison, but he's someone who was very much feared, he's going to have connections. And he might've heard about the custody case-- it might not even be just about Kim not getting custody, but his brother. He could really hate his brother and wanted to ensure that he wouldn't be in his daughter's life.
There's also the fact that how the uncle found out about Makayla hasn't been mentioned. Could be an oversight by the writers because it wasn't important, but it also could be because there's a bigger story there. Maybe the uncle found out through his brother or his brother's attorney. He might not even be aware of this, his brother's attorney could've helped orchestrate the uncle finding out because he wanted to ensure his blood was in charge of Makayla/be able to find out things about her more easily. After all, the last thing we heard from him was him saying I'm never gonna see her am I (to Kim, which look. I could wax lyrical about all day long).
This links into my second point: I've seen a lot of people say that the uncle's expression looked sketchy whereas to me it looked understanding-- which gives me hope that Kim will reach out and offer him a role in Makayla's life. But his wife? It could be because she was just trying to be supportive of her husband and remain impartial, but there could be something off, especially with them not having kids together. His wife could have been how he heard of Makayla, because she found out through bio father's connections-- and she just didn't mention that to her husband because she knows how he feels about that side of his family. It could even be that she didn't realise what kind of people she was getting into bed with, and not realising that them losing would cause such drastic actions.
