Notorious rapist and killer Adrian Ernest Bayley has had a legal victory that brings him one step closer to being eligible for parole in his 70s instead of his 80s. But the Victorian government will consider changing legal aid laws after a court granted Bayley a second chance to apply for taxpayer-funded lawyers in his appeal against two rape convictions. He had launched legal action against a Victorian Legal Aid independent reviewer after his initial bid for legal aid was blocked.

But the Victorian government will consider changing legal aid laws after a court granted Bayley a second chance to apply for taxpayer-funded lawyers in his appeal against two rape convictions.
He had launched legal action against a Victorian Legal Aid independent reviewer after his initial bid for legal aid was blocked.
Already serving life for the 2012 rape and murder of Melbourne woman Jill Meagher, Bayley wanted to appeal against additional rape convictions handed down earlier this year.
If successful, an appeal would have reduced his current non-parole period of 43 years to something closer to the 35 years imposed when he was jailed for Ms Meagherās murder.
The state government in September formally intervened to prevent Bayley, 44, accessing funding for an appeal.
On Friday, Victorian Supreme Court judge Kevin Bell ruled in Bayleyās favour and ordered VLA to refer the decision to a different independent reviewer.
Attorney-General Martin Pakula said the government was disappointed in the outcome and would read the decision to see whether any amendment to the Legal Aid Act was necessary.
āWeāll examine the judgment, weāll examine the reasons given by the court and weāll assess whether any amendment is necessary,ā Mr Pakula told reporters on Friday.
In his judgment, Justice Bell said legal assistance cannot be denied because an applicant is notorious, unpopular and has prior convictions.
āAll persons are equal before the law and the Legal Aid Act requires consideration of applications to be objective, criterion based and non-arbitrary,ā Justice Bell said.
During the hearing, Saul Holt SC, acting pro-bono for Bayley, told the Victorian Supreme Court that denying Bayley legal aid is a breach of the charter of human rights.
Weaknesses in the prosecution case against Bayley left open the likelihood that someone else committed the offences, Mr Holt said.
Shadow attorney-general John Pesuttos said Victorians had every reason to be deeply disappointed that Bayley can now continue with the appeals process.

The mini-series is a dark delight, just as these playfully grim ads are. This isnāt a comics blog, of course. And Rich and Jonesā mini series wonāt be for everyone. But the art is still terrific, and those ads are fun. The illustration style and typography is strictly now, but the coloring and general āfeelā are pure retro. AndĀ weāll admit it: We love retro, and get a real kick out of seeing contemporary tweaks and twists of vintage 20th century design, illustration and photographic tropes. Considering I had to learn and demonstrate strategies to take down an armed attacker before I could even do unpaid work in a school for a semester, this is legitimate.
This is the Batman we need to see more often. The one who remembers what it was like to be a scared child, one who knows how to handle situations delicately.
One of the reason why I love batman so much. He is portrayed as a very careful and guardedĀ man. But he is probably the most human out of anyone. Itās why he is the knight that gotham deserves.Ā
More than just being instinctively compassionate, the Batman in the photoset, at least, knows (and was probably trained in, i.e. actively sought out the knowledge) how to handle a person whoās been traumatised and their sense of self threatened without further trampling all over their boundaries. he asks for permission to talk to her, he warns her heās coming closer instead of just imposing his presence on her. That is not something you know instinctively even if you know what itās like to be scared or went through trauma yourself, it takes awareness because it means not acting as one usually would.
This Batman is compassionate, self-aware and sensitive, so Iām not even surprised the machismo fest that was Nolanās version did away with all that.
