I remember clear as day when, ten years ago, I over heard my parents saying that my uncle had beaten my heavily pregnant aunt until she passed out and that she refused to go to the hospital in fear of what he might do.
He almost killed her, pushing her down a flight of stairs in front of my grandmother. My aunt, out of fear, never said a word about it.
Once he scammed his friends out of $15000 and escaped to Italy out of fear for his life, where, after dragging her to another country where she didn’t speak the language, he left her alone without a cent working as a dishwasher in a ratty restaurant in exchange for food and a place to stay. He didn’t come back until six months later. They got divorced practically as soon as they returned to Argentina.
A year ago he beat her to a pulp at her own front door. This time she pressed charges, and a restraining order was emitted against him to keep him away from both her and the kids.
He’s a powerful and well connected man. In his own words, he wants her to rot under a bridge, wants her to be so desperate she’ll have to become a prostitute. He refused to pay alimony for the last eight years. And it’s not about the money: he believes she (and consequentially the kids) don’t deserve anything from him.
My aunt is an independent and struggling professional writer and actress. She manages to afford the cost of living with her two children, but now he’s trying to take the kids away and she can’t pay the lawyers she needs to keep him from succeeding. His contacts in the system arbitrarily took away her children and gave them to his mother, a woman in her 70s, without a single psychologist or social worker being consulted in the matter, despite not having the authority to do it or the case depending on their jurisdiction. The police literally threatened to put my aunt in jail if she refused to go with them to the Child Protection office in another county.
Instead of taking care of them, my aunt’s ex mother in law gave them to her son immediately. So now, despite having a restraining order that prevents him from being alone with the kids, he’s got them in his house.
This is not only illegal, but also since we’re on summer break in Argentina, the kids have been literally locked in his place five days a week for the last two months.
This has proven to be horribly scarring for the kids. My aunt has been receiving alarming calls from my little cousin, age 9, while hiding in the bathroom so they can’t listen to them talk, since they don’t know she has a phone. The eldest, 11, says their father has told them that “mommy used to hurt herself and then lie and say he did it”.
My aunt has pressed charges twenty six times already in the past two months. She’s been advised to record evidence and bring witnesses that testify the kids are under the father’s care.
However, documents have started disappearing. I personally testified numerous times that I had joined her to try and see the kids, and that I found them with their father. However, there’s no registry whatsoever of my declarations. They have vanished into thin air.
Now more than ever she needs a good lawyer.
Simply scheduling a meeting costs $1000 Argentinean pesos ($50 USD). By the end of the process this will end up costing around $5000 and $7000 USD, but it’ll guarantee he won’t ever come close to her or the kids again.
Every cent she makes that isn’t destined to sustaining basic needs will be destined to pay for the lawyer, but we need help. My family and her friends have been lending a hand, but there’s only so much we can do.
