One of the most important things I learned in my Language and the Law class is that law enforcement will intentionally misinterpret every type of statement asking for a lawyer as not asking for a lawyer. Even directly saying it like this “I will not speak to you without a lawyer” can be taken as a simple statement of fact rather than a request for a lawyer. You literally have to state “I am now invoking my right to a lawyer” and every time they try to proceed with an interrogation you have to answer every question with “I am invoking my right to have a lawyer present”. You can’t just tell them you won’t talk without a lawyer or that you want a lawyer. You have to state that you are invoking your rights. Otherwise they could just say “well they just said they wouldn’t speak without a lawyer present. That’s not invoking their rights to a lawyer. It’s just stating a fact.” even just stating your right to a lawyer doesn’t count!
PLEASE share this addition. I am a lawyer who works in criminal defense, and this is one of the most avoidable things that people consistently get wrong about the Miranda rights.
Here are some more “ambiguous” phrases which courts have found DO NOT invoke your right to a lawyer:
“Maybe I should speak to my lawyer first.”
“I might like a lawyer.”
“I think I should have a lawyer present for this.”
“Could I speak to my lawyer first?”
“How long until my lawyer gets here?”
And perhaps most egregiously – “Get me a lawyer, dawg – ‘cause this is not what’s up.”
Here are the magic phrases which you need to know if you want to invoke your Miranda rights:
1) “Am I free to leave?”
It’s worth asking this even if the answer is obvious. Even if the officer does not let you leave, by forcing them to admit that you are not free to leave, you are creating a record which your attorney can use to prove that you were in custody. Miranda rights only apply if the interrogation is custodial, meaning that police officers will frequently claim that their suspects were “not in custody” to get around their Miranda rights.
2) “I am invoking my right to remain silent.”
Simply staying silent will not invoke your right to remain silent. As absurd as this is, you must explicitly say that you are invoking your right to remain silent in order to invoke that right.
3) “I am invoking my right to an attorney.”
As stated above, you must be not only clear and unambiguous, but clear and legally unambiguous. Don’t get cute. Don’t get sassy. And on the flip side, don’t get intimidated and use verbal ticks to minimize your request. Say the line with those words exactly – say it clearly, and say it once, and then say nothing else.
Because even after you’ve done all this, the police can still try to get you to talk. They’re not supposed to interrogate you, but they’re allowed to make casual conversation, and if that conversation just happens to circle back around to the thing they wanted to question you about, well, that’s really your fault for talking after you said you wouldn’t, isn’t it? Can’t possibly fault the poor officers when you initiated – if you really wanted to have your rights respected, you wouldn’t have talked to them in the first place.
The police know this, and they will mercilessly exploit this loophole. So, once you’ve successfully invoked your Miranda rights, any and all conversation you have with police officers will put those rights back into jeopardy.
Putting it all together:
Ask: “Am I free to leave?”
If they say no, say: “I am invoking my right to remain silent and I am invoking my right to an attorney.”
And then shut up and do not say a single thing to them for any reason whatsoever until you have actually spoken to an attorney. Yes, even if it takes hours. Yes, even if they start talking to you about something else.
Finally, a very important disclaimer:
I may be a lawyer, but I’m not your lawyer, and I cannot guarantee that what I’ve just laid out here will always work for every situation. We didn’t get to this bizarre and absurd place overnight – we built this ridiculous system piecemeal, by deciding on a case-by-case basis that certain phrases were “too ambiguous” or certain types of questioning weren’t actually questioning at all. The law is still in flux, and is still fundamentally out to get you, and willing to bend plain meaning beyond all recognition to do it. Even if you invoke your rights perfectly, exactly as I have specified above, there’s a chance that your invocation of rights will be disqualified on some new technicality that no one’s even thought of yet – and that’s precisely the problem.

I am begging my followers to please watch this video from start to finish. I know it’s long, but it is incredibly valuable information that everyone needs to know, especially if you’re involved in any form of activism.
Every single cop lies. Every single cop lies and manipulates and twists the situation around to get a confession. Even when they know that the person is innocent, even when they know that what they have isn’t enough to convict someone, even when they know that that confession has been made under duress or manipulation. All they care about is getting anything to put someone behind bars.
It doesn’t matter how eloquent or innocent or experienced you are. Do not talk to cops.
The video is a doozy. Aside from all the good advice, the racist dog whistling from the officer really jumps out. In fact, his whole segment was pretty effective to drive home the point that officers are literally trained to manipulate you and fuck you over. He does say he doesn’t “try” to put innocent people in prison, but he never says he tries to keep them out either. He also explicitly states that he destroys material that could be helpful to you.
In short, DO NOT TALK TO COPS.

now, not everything people self-medicate for actually has a proper treatment. i’m pretty sure the reason my uncle made sure to be slightly drunk at all times ‘to round the sharp corners off of things’ was sensory processing disorder. i have that too, and i just kind of accept that i’m going to randomly get my brain sandpapered from time to time. there is no medication for that. all you can do is dull your senses. i’ve chosen not to, but i can’t blame him for his decisions. when a ringing phone feels like getting hit upside the head with a frying pan, liver damage sounds like a fair price to pay.
anyway, it seems really self-evident to me that people don’t enjoy living the life of an addict, they do it because the alternative looks worse. people don’t get addicted to substances just for funsies. they start making a habit of taking something because of insomnia, or grief, or headaches, or depression, or seething undirected rage and terror they can’t put a name to – something that they can’t ignore or shrug off. and for whatever reason – lack of access, lack of knowlege, lack of money, or it just plain doesn’t exist – they aren’t able to apply the Approved Correct Remedy. they use what they can get.
addicts aren’t some weird otherfolk who inexplicably just Do Drugs because they’re Bad. addicts are you with a problem you can’t solve.

I’m laughing, but there’s a super useful corollary, which my husband calls “the Red Balloon.” He was a defense lawyer and had a fair number of drug addicts come through, and there is a thing where if you’re like, on your first offense, they’ll do a thing where you can go to treatment and if you complete it they’ll take the conviction off your record. And he would tell his clients, “Look, everyone’s going to tell you not to do drugs. They’re going to say it over and over again. And it’s like, if people tell you not to think of a white elephant, you’re going to think of a white elephant. But the trick to not thinking about a white elephant is to think of a red balloon. So you need to find your red balloon. For some people it’s yoga. For others it’s woodworking. For some people it’s scrapbooking or gardening or any of a long list of things to do. They focus on that, it’s a lot easier to succeed in ignoring the white elephant.” So yeah, “watch yourself” is one thing… but the better idea is to watch something else. (Even if it’s fanfic about werewolves fucking.)
It’s a form of productive dissociation, and is super, super helpful. It’s easy for me to get bogged down in how much pain I’m in… but some of the most painful periods of my life have also been the most productive, writing-wise, because writing is one of my red balloons.
There is a phrase I use A LOT in my parenting and my son gets very sick of it, but it’s true:
The thing you practise is the thing you get good at.
You may not intentionally be practicing “being grumpy” but if you don’t put effort into practicing “not being grumpy” then I’m afraid that’s what you’re doing. It’s hard! It’s really hard! Sometimes, for some things, it’s pretty much impossible and that sucks!
But being carefully aware that you are going to get good at the things you do most of is a good way to be more careful of what those things are. If that makes sense.

The thing with neurodivergent folk and rules is that if they don't understand why a rule exists they will not follow it ever

Ok I want to say something controversial
But you are responsible for your own safe spaces. You can block tags, block words, block people.
“But i thought fandom was supposed to be a safe space” —yeah you have to curate it.
Unfortunately one persons’s safe space may be another persons’ trigger. That’s ok. Simply block them, block the tag, block the word etc. They can do the same for you.
Maybe I’m just out of touch, but I’ve been around since the days of “don’t like, don’t read” and that’s a good philosophy. If it squicks you, scroll past. If it causes you anxiety or upset, block! Plenty of people are responsive if you ask them to tag an upsetting trigger. And if they’re dicks about it, block em.
Since different people have different needs, one person’s safe space will be another’s Trauma Central.
I don’t know who said it first, but “I need to be able to express my anger without shame” and “I need to be away from yelling and loud noises” are both valid needs people can have for a safe space that really aren’t compatible with each other.
So are “I need to process my trauma” and “I need to not meet any trauma.”
Or “I want a safe space to tell/read the stories that speak to me” and “those stories are distressing to me.”
Insisting that your needs are the only needs anyone should have is not a safe space, it’s its own act of violence.
You don’t get to make others homeless to make the universe your personal safe space.

OP what does this mean?
When your friends are hungry, you cannot serve them from an empty breadbasket, no matter how good your intentions. When they're thirsty, you cannot serve them from an empty pitcher, no matter the effort you put in.
We have to stock ourselves with good things before we are able to give them away, and if we are too exhausted to make bread, we must rest before we can make it to serve our friends. If we are too hungry to serve, we must eat some bread ourselves first.
It's a metaphor for emotional exhaustion. When we wear ourselves down it makes it difficult or impossible to help the people around us, and all the effort and good intentions in the world can't make up for the fact that our vessels are empty. It's hard to not want to serve when our friends are in trouble, but trying to serve from an empty vessel often leaves both of you floundering.
On the contrary, when we care for ourselves and are kind to our body and mind, we are full vessels, and serving the people around us becomes easier. That's why it's important to take time for ourselves once in a while, to refill ourselves with good things.
In the event of a sudden pressure change, put on your own oxygen mask before helping a companion with theirs if needed.

I've given myself heat exhaustion AGAIN (heck, I hope it's only heat exhaustion, rip) and I am not here for it ffs so to make sure y'all know about it, imma share the signs of heat exhaustion!
Heat exhaustion is quite literally your body getting too hot and Exhausting itself to cope. Heatstroke is your body Failing To Cope.
Heat Exhaustion signs include:
You get a headache that Will Not Go Away
You feel confused and dizzy (balance who? Idk her)
You don't feel hungry but you feel sick as well (this sucks and happens a lot in high heat so try and snack regularly)
Sweating and clammy skin like the kind that has people go "you're freezing!" because you've sweated so much you literally end up with a chill on your skin
Cramps. Feckin cramps. Arms. Legs. Stomach. They suck ass.
You have a heckin fast pulse or you're hyperventilating like you've just had a Scare
Your body temp is over 38°c (because you're literally boiling like a lobster in a pot)
You are Beyond Thirsty and no matter what you drink it Does Not Abate
If you end up experiencing any of these symptoms, or multiple, and you're in a hot/warm environment, then sit your ass down in the shade, get something to drink, and get a damp cloth on your head or a change of clothes that are cool.
Basically, stop what you're doing and give your body a chance to Not Keep Boiling
Heat exhaustion is NOT THE SAME as a heatstroke.
Heatstroke is So Much Worse™.
Heatstroke signs include:
Still feeling like utter shite 30 minutes after you sat your ass down, rested in a cool place, and rehydrated
Not actually sweating even though you really do feel like a lobster in a pot that has the heat up High
Your body temp is 40°c+ (which is bad btw, that's temp for causing your to pass out etc)
Hyperventilating/fast breathing or actual shortness of breath (I struggle with this because asthma so I'm always like "idk if I got this oops)
Feeling confused but in a like "I don't know what's going on, I can't think, I have no idea about anything, someone help me please I'm crossing into traffic and don't even realise" way
Having a fit/seizure because your body temp is so high your brain is Actually Getting Boiled In Your Skull 🙃 [upside down smiley emoji]
Passing out and not actually responding or waking up from a brief fainting spell (this is the Serious™ kind of passing out that has doctors going "oh shit, we need an IV STAT!" or whatever it is they say when Shit Is Going Down)
Heatstroke can be really dangerous if it isn't treated quickly so please don't ignore these signs. Right now, I'm in a cool environs, with hydration, and am avoiding moving and am gonna have a nap because I'm going very dizzy, can't focus properly, have a headache, and am only coherent here because I'm HyperFocusing on this post. I can't even understand words being said to me right now hence nap, hydration, and cool environs.
So please, y'all, take care of yourselves. Seriously.

Some additional hot weather tips
If you have low blood sugar, but are having a hard time eating because you feel crappy from the heat, try sucking on some hard candy
If possible, after you get out of the sun/heat drink Gatorade or something similar to replenish what you've been loosing from sweating
When drinking water or Gatorade (no matter what you have it is important to stay hydrated!) it is important to drink slowly, even if you are very thirsty, because if you drink too fast the water might come back up
In hot weather, bandanas are very useful, even as a preventative measure, because you can pour some water from you bottle (or anything else) on them, and then put them on your head (as mentioned above) or neck. A few other areas help as well, like armpits, but I would personally recommend your neck.
It is not recommended to use a fan at or above 99°f or 35°c, because they can actually start to make the heat worse. (I know these are different temps, the recommendations come from different governments, 35°c is around 95°f, but this also depends on conditions like humidity, so just use your best judgement with this info)
Most importantly, if you think you are getting heat stroke call 911 or your equivalent, heat stroke kills several people each year, even in my area, where it normally only gets to 100°f for a few days each year
For fahrenheit users,
38°c = 100.4°f
40°c = 104°f
Remember to stay safe in warm weather
Well shit, I had most of those Sunday Morning, can heat exhaustion continue to hit even after you've moved into a cool environment, rehydrated, eaten, taken a long warmish-coolish shower and then slept for 7 hours?
Because those symptoms match the the symptoms I had last Sunday and made me feel like shit upon waking up.
They can yes @artisanscribbles because heat exhaustion takes time to go away. You may well feel a bit under the weather for a few days after experiencing it, and any sort of exposure to heat without proper precautions can make it flare up again and worsen into heatstroke.
It's why it's so important to rest and keep hydrated when it's warm. I hope you eventually felt better and maintained your hydration levels with water and other fluids.
I had three days of feeling the after effects of heat exhaustion myself and felt like I had a cold, a constant headache, and random chills all at the same time as having a dry throat, not sweating properly, dizziness, and even muscle cramps from the rapid dehydration I experienced.
In general, to anyone who sees or reblogs this:
It's really important to take care of yourself, both immediately after you recognise you've got heat exhaustion, and in the long term. It can affect you for days after.
Please take care of yourselves aka TAKER:
Take breaks
Avoid too much sun
Keep hydrated
Eat regularly
Rest

One under-appreciated breed of fic writer are the ones who hyperfocus on logistics to the exclusion of all canon shortcuts, and thus usually strike upon an awesome way to flesh out the worldbuilding or characters.
Like, I’m not necessarily talking realism here since often it’s still pretty far from realistic, but more like, “someone has to be running spies in this fantasy kingdom, and we’ve seen the whole royal court, so which background character is it? How does that change these three major interactions?” Or “real life historical nobility did in fact have some things to do that were like jobs, how does this human disaster cope with running an estate?” Or “there’s no reason for a sci-fi robot detective to know how to whitewater kayak, where’d she learn?” Or “if this guy is serving the emperor directly he has to be way high up in the space empire servant hierarchy, why is he doing this menial task for someone else? What’s his motive? Does he perhaps have the secret space telepathy?”
Anyway I’m always DELIGHTED to find a fic or writer who asks these questions because the fics themselves are universally bangers.
