“Mama always said I was a rebel”
having gay sex is like the least problematic thing that has happened in that US senate hearing room
The only problem is that it wasn’t considered one of the historic events that took place in that senate hearing room.
People always bring up the “yelling fire in a movie theater” analogy as an example of a reasonable restriction on free speech, even though it’s entirely unreasonable.
You know where that analogy comes from? The Supreme Court used it in Schenck v. US (1919) to justify jailing a man who passed out fliers which encouraged young men to resist the draft during World War I. Justice Oliver Wendell Holmes said “The most stringent protection of free speech would not protect a man falsely shouting fire in a theatre and causing a panic” to make the case that there were certain circumstances in which free speech could reasonably be limited. Except the activist in question was accurately shouting fire in a crowded theater, he was informing others about a real threat to their lives caused by government policy.
His sentence was upheld because the court found his actions posed “a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent”- the evil of draft dodging during a pointless war. The government has the right to decide whether the fire is real or not. And somehow this disgrace has come to be seen as a reasonable limit on the right to dissent.
An important corollary to this, that people also misinterpret the significance of, is that a few decades later in Near v. Minnesota, the "clear and present danger" standard was narrowed to "reasonably probability of harm". Which sounds bad, right? Much more fuzzy, leaving even greater room for the government to interprete the facts to its satisfaction than the old standard.
Except that's not the main holding of Near. The main holding is that the government cannot preemptively sanction or censor speech that hasn't yet been spoken even if that speech might be unlawful or libelous, except if that speech poses "a reasonable probability of harm."
This doctrine prohibiting government from the "prior restraint" of speech is possibly the most important element of 1st amendment law as it has in practice broadly prohibited routine government censorship.
So not only was the "fire in a crowded theater" case a loss for free speech, the case often derisively cited as an erosion of that "victory" was in fact more affirming of free speech rights than it's predecessor.
This had me shook for a minute.
The 1st Amendment going from clear and present danger and the government has the right to decide whether the fire is real or not
To reasonable probability of harm and the court can’t say shut up anymore just because it doesn’t want other people to hear what you’re saying bc it’s true and would inconvenience/could get them in trouble.
I’m losing my fucking mind.
oh my god
my favorite part is that the guys just go along with it in spite of confusion/misgivings because they don’t want to miss out on stickers.
Wow
This still is and always will be one of the best posts on the internet.
Just found out I was thirsty not by receiving a signal from my body about it but by dozing off and dreaming about cold water from different alluring angles. This is great. I think all my wants and needs should be revealed to me this way
This can’t be topped

Hey btw if you don’t know how to program, you should check out [novelty], which is a free Visual Novel creation software. Absolutely no programming required, and it’s super easy to use, I played with it some when I was a teen but the only reason I didn’t do much with it is cuz I made my story complicated and had like 5000 different branching routes that kept spawning new routes and made myself confused LMAO
But yeah, it’s a WYSIWYG with a really straight-forward GUI, if I remember correctly.
It even comes with some free backgrounds and characters and stuff, and this is what it looks like:
Did I mention it’s super duper free? It hasn’t been updated since 2010, but it has basically all you’d need to make a simple visual novel.
Just make sure your DirectX runtime is updated, cuz it can act buggy if it’s outdated, but this program is so old that I doubt it’d even be an issue lol
holy shit
This is so cool? Can you imagine fanfic in this format?
@becausedragonage @ashidoodle can I recommend Choice Script? It’s like a choose your own adventure coding program. The finished product looks like this, where every option sends you down a different path:
They are literally books you can play. You can even insert your own character’s name and pronouns and that would make writing reader inserts so much easier And as a writer who can not art, writing and making dating sims and games is more convenient.
The coding is also super simple and easy to learn and all it requires other than the program files is a text editor. And just like that you can start typing up like you would your own fanfics or stories. Plus it’s very versatile so you can make your game/book as simple or as complicated as you want, and even implement stats and inventory systems.
AND CHOICE SCRIPT IS ALSO SUPER DUPER FREE. THE COMPANY EVEN PUBLISHES YOUR FINISHED GAME FOR YOU AND GIVES YOU ROYALTIES IF YOU CHOOSE TO SELL IT. THE PROGRAM STILL GETS UPDATED AND THE COMPANY PUBLISHES BOOKS EVERY MONTH INCLUDING THE FANMADE ONES. THERE’S ALSO A FORUM FOR PEOPLE TO POST WIPS AND TALK ABOUT CHOICE SCRIPT AND GET HELP.
And there’s Ren'py, also for visual novels!
@raimeyl @mexicanesecat 👀
Holy shit
Ooooof I’m gonna use thessee
For any burgeoning digital storytellers/narrative game devs out there! :)
any programs like these for mac?
Some girl in my class was talking about McDonald’s shamrock shakes and this yeehaw dude in cowboy boots said they suck and then he looked me in the eyes and said “what you’re gonna do is go to Arby’s, and get yourself a mint chocolate chip shake.” And he said it with such authority and certainty that I did so as soon as I got in my car
Did you know wikihow gets all its images from traced stock photos so they don’t have to pay for them?
That’s a really bad trace, dude.

Barnes and Nobles is gonna start serving food and alcohol.
Everybody’s cracking jokes about how it’s a desperate attempt to stay relevant in the age of Amazon.
But you know what? Props to them. This is exactly what Blockbuster didn’t do. At no point was Blockbuster like “Hey, movie rentals aren’t the lucrative enterprise they once were. Perhaps it’s time we become known for our cheesy garlic bread.”
Okay but…if someone wants to take me on a date to a Barnes and noble and get me dinner and a drink and then let me peruse the stacks like I’m not saying no. A sandwich, a beer, and 2-5 books on various topics I hope I’ll someday read about? Good night.

can i jsut say… isnt it insane that polar bears go underground like imagine just walking along with a shovel and u start digging a hole and a bear is in there
THEYRE JUST? THERE…. IN THE SNOW
I know it‘s supposed to be scary that there is apex predators just potentially sleeping under the surface of the snow like some kind of greek mythology monster but it just makes me laugh bc them living in holes just means polar bears just have little houses and look out of their little windows like:
