1. jkr did not take this photo.

2. The photo is taken from the front and in the setting of a public gathering, not from an angle that would constitute upskirting.

3. In the image, no specific skirt is visible that the camera is directed underneath.

4. The individual's attire is clearly visible in the frontal view.

5. The individual is aware of his own appearance .

6. Sexual assault means non‑consensual sexual contact or behavior, not the dissemination of such a photo (even if accompanied by mockery).
