"The Montana court separately declared that transgender people constitute a suspect class under the state's equal protection clause. In legal terms, a suspect class is a group that has historically faced such severe discrimination that any law targeting them must meet the highest level of judicial scrutiny to survive—the same standard applied to laws that discriminate on the basis of race. [...] The practical effect is sweeping: any Montana law that singles out transgender people will now face strict scrutiny, meaning the state must prove the law serves a compelling interest and is narrowly tailored to achieve it—a standard that laws almost never survive.
"Because the decision rests entirely on the Montana Constitution, it is insulated from the U.S. Supreme Court. Under the principle of adequate and independent state grounds, the federal Supreme Court cannot review a state court's interpretation of its own constitution, so long as that constitution provides more protection than the federal one. [...] What this means in practice is that Montana's transgender residents now have a constitutional shield completely independent of the Supreme Court of the United State’s decisions."

I am an attorney who tracks regulation for a living. That the FDA is being so secretive about this is HIGHLY unusual.
As my followers may know, I usually don't recommend submitting "I don't like this" comments on proposed rules. However, in this case, I think its worth it to generate a robust public record opposing this shit. The tips on how to draft more in-depth comments are excellent, and I would encourage submitting substantive comments if you can - particularly if you are a medical expert or have some other kind of relevant expertise. However, if an "I don't like this" comment is all you're able to submit (no judgment btw, submitting a substantive comment is not easy), do it. I'm not convinced that we'll change FDA's mind here, but we can create an overwhelming public record which could be useful for any future legal challenges.

Did some googling and if anyone needs the extra context like me: Lisa Littman is a researcher who made up the idea of rapid-onset gender dysphoria (i.e. the idea that gender dysphoria is a result of peer pressure). she published her "study" where her entire methodology was surveying parents on anti-trans websites. idefk how she still has her credentials and they weren't revoked, bc this kind of scientific misconduct is on par with the guy who faked the "vaccines cause autism" study.
J Michael Bailey is a researcher who published The Man Who Would Be Queen, where he cherry picked scientific research and twisted around the facts to make an argument that trans women are either 1) an extreme expression of homosexuality or 2) fetishists with autogynephilia. it is genuinely NUTS how many controversies and allegations of sexual and scientific misconduct there are around this man. yikes × a thousand. this is not the first time he tries to recruit trans people for a study and intentionally twists everything around to argue against their existence; there are MANY participants of previous studies of his that have come forward about how fucked this whole thing is.

Miss Major Griffin-Gracy, a Black transgender woman and longtime activist who once lived in the Bay Area, died October 13.

This is really really scary, but it helps to remember that there's only so much they can directly do.
The thing that is going to turn this around is by CIS PEOPLE being LOUD and OBNOXIOUS about this as much as possible. Your trans friends are expecting you to fight for them, and your silence is a betrayal.
Remember that normal people are completely unbothered by trans people, and it's only the nazi nutjobs who think like this. The problem is that the nazi nutjobs are VERY loud and VERY angry about problems that they made up to distract you from the problems that they created.
You need to be just as loud and angry about it! Do not stop shouting that trans rights are human rights! Do not give them an inch, even for things that might seem insignificant like sports or public bathrooms or healthcare for teens.

Two years after being tasked with commissioning a review of medical evidence surrounding gender-affirming care for trans youth, Utah’s own state health department has concluded that trans healthcare bans “cannot be justified.” The Republicans who commissioned the study aren’t too happy about it.
Back in 2023, Utah Governor Spencer Cox signed a bill that placed an indefinite “moratorium” on doctors prescribing gender-affirming care like hormone therapy and puberty blockers to trans youth. That bill ordered the Utah Department of Health and Human Services to compile their report in order to produce recommendations for the state government on whether or not to lift the moratorium.
This week, the department delivered their long-awaited, over 1,000-page report — which is dated August 6, 2024 — to Utah lawmakers. The report’s authors found that “the consensus of the evidence supports that the treatments are effective in terms of mental health, psychosocial outcomes, and the induction of body changes consistent with the affirmed gender in pediatric GD [gender dysphoria] patients.”
The authors added that “the evidence also supports that the treatments are safe in terms of changes to bone density, cardiovascular risk factors, metabolic changes, and cancer.” Trans youth who had received gender-affirming care were within the bounds of normal, non-pathological ranges for these conditions.
