Trump attempts to criminalize political speech.

On Tuesday, Trump unleashed an assault on the First Amendment by attempting to criminalize political speech. The DOJ indicted former FBI Director James Comey for a May 2025 Instagram post featuring a collection of seashells Comey found on a beach, arranged by someone else, in the sequence â86 47.â
The most obvious interpretation of those numbers is âGet rid of Trumpâ through political action, such as impeachment, conviction, and removal under Article I of the Constitution, or through the 25th Amendment. See NYTimes (â[T]he slang term â86â [is] often used to mean dismiss or removeâ).
The use of the number â86â to refer to impeachment has been in use on both the right and left sides of the political spectrum over the last decade. Gretchen Whitmer wore a â86 45â pin during Trumpâs first term, conservative commentator Jack Posobiec posted â86 46â to call for the impeachment of Joe Biden, and former Rep. Matt Gaetz used â86âdâ to refer to the removal of Kevin McCarthy from his position as Speaker of the House. No part of Comeyâs message suggests political violence in general or directed at Trump in particular.
The indictment will be dismissed on the merits before the matter is tried before a jury. The bare bones indictment is here: US v. Comey. Moreover, the âUS Attorneyâ on the indictment is W. Ellis Boyle, who has exceeded his 120-day interim appointment by Pam Bondi. See Eastern District of North Carolina | Meet the U.S. Attorney. Recall that the first indictment against Comey (in the Eastern District of Virginia) was thrown out because Lindsey Halligan was not properly appointed as interim attorney by Pam Bondi. Trump has made the same mistake with Ellis.1
The indictment of Comey for posting an Instagram picture with â86 47â is a bad-faith action by every DOJ attorney who signed or filed the indictment or approved the effort to secure it. The relevant bar associations should immediately open disciplinary investigations into each attorney noted above to determine what evidence, if any, supports the allegation in the indictment that Comeyâs seashell message communicated an intent to harm the president.
The obvious answer to that question is that no such evidence exists, and the indictment was sought to placate Trump as Todd Blanche grovels before Trump in an effort to secure a nomination as Attorney General.
The indictment is so flimsy that Fox News legal analyst mocked the indictment in an op-ed in the National Review. See Mediaite, Andy McCarthy Slams Trump DOJâs âAbsurdâ Comey Prosecution.
McCarthy said,
If itâs possible, the Trump Justice Departmentâs new indictment of former FBI Director James Comey is even more absurd than the previous indictment. That one failed to state a crime. This one fabricates a crime.
Shortly after the DOJ indicted Comey, the FCC ordered early license renewal examinations for ABC affiliates after Melania Trump demanded that ABC fire Jimmy Kimmel for saying that Melania had âa glow like an expectant widow.â See NPR, Following Kimmelâs Melania Trump joke, FCC orders early license renewal for 8 ABC stations. The FCCâs early renewal action against ABC was unprecedented and was clearly intended to exact retribution against ABC.
The actions by the DOJ and FCC follow in the wake of demands by everyone in MAGA world that American citizens stop saying mean things about Trump. You know, like he attempted a coup, incited an insurrection, admitted that he felt free to grab women by their genitals, was found by a civil jury to have committed sexual abuse, was convicted of thirty-four counts of fraud, was found civilly liable for having defrauded banks over decades, is violating the Constitution daily by withholding funds appropriated by Congress, started an illegal war against Iran, threatened to inflict war crimes on the Iranian population (a threat that is itself a war crime), is ordering the extrajudicial killings of people on the high seas suspected of drug smuggling, is issuing facially illegal executive orders to suppress votes, is calling for the execution of various political opponents by claiming they have committed treason by opposing him, and is engaged in the largest monetization of the presidency in American history, past, present, and future.
I could go on, but you get the point. There are plenty of things to say about Trump that might hurt his feelings, but they all have the virtue of being true. And even if statements that hurt his tender feelings are only opinions that might be contested by Trumpâsuch as âTrump is attempting to institute a fascist government in Americaâ or âTrump is an immoral person responsible for the deaths of hundreds of thousands of people across the globe by gutting USAIDââsuch statements are protected by the First Amendment to the US Constitution.
The actions by the DOJ and FCC are merely the latest maneuvers by Trump in his attempt to intimidate the media. He has been using the same playbook for nearly a decade.
Do not be intimidated by Trumpâs bluffs and bloviating. The indictment against Comey is a joke, whose sole purpose is to force Comey to spend money on legal defense. The licenses of ABCâs affiliates will all be renewed because there is no ground for revocation. Again, Trump is merely looking for ways to force his enemies to incur costs.
Trumpâs actions are reprehensible, but they are signs of desperation and weakness. Taken together, the indictment and early license renewal demonstrate that the criticism of Trump is finding its mark hidden beneath Trumpâs thin skinâi.e., his monstrous ego.
Trumpâs desperation signals that we are winning, a fact that should spur us to greater action. Keep up the good work! Letâs â86 47â by impeaching, convicting, and removing him from office under Article I or the 25th Amendment.
The mediaâs attendance at the White House Correspondentsâ Dinner
I was disappointed by the mediaâs attendance at the White House Correspondentsâ Dinner and had intended to write about it on Sunday, but deferred commenting because of the violence on Saturday evening.
How does Trump get away with bullying the media by threatening criminal action? Simple. The media allows him to. No, thatâs not quite right. The media rewards him for threatening and bullying them.
Case in point: The White House Correspondentsâ Dinner last Saturday, an event designed âto ensure a free press.â That would be the same press Trump has described as âthe enemy of the people,â âdishonest,â âcorrupt,â âlow-life reporters,â âbad people,â âhuman scum,â and âsome of the worst human beings youâll ever meet.â
When asked by Leslie Stahl why he attacks the press, Trump said, 2
I do it to discredit you all and demean you all so that when you write negative stories about me no one will believe you.
In short, Trump has admitted that his motive is to destroy the mediaâs credibility by attacking and dehumanizing journalists.
How did the White House Press Corps respond to such attacks? Well, last Saturday, they invited him to a black-tie dinner as the keynote speaker at an event celebrating press freedom. Journalists dressed in ball gowns and tuxedos, paid $50,000 for a table near the bigwigs, and rubbed shoulders with administration officials. But for a failed assassination attempt, Trump was prepared to excoriate the press for being the âenemy of the people,â âhuman scum,â and âsome of the worst people in the worldâ (or some equivalent series of insults).
In short, Trump indicted Comey and attacked ABCâs license because he knows that he will not be punished for doing so. Instead, he is rewarded by members of the press eager to take his call so they can report that they spoke to the president.
Imagine a world in which every reporter and every news organization boycotted the White House Correspondentsâ Dinner. Imagine a ballroom that was nearly empty except for Trump administration officials like Kash Patel, Pete Hegseth, and Karoline Leavitt.
What message would Trump have taken from an empty ballroom? I am not naive enough to believe Trump would be chastened. But he would not take the message that âI can say whatever I want because the media will never do anything about itââthe message he received on Saturday evening before the violence.
I was sorely disappointed on Saturday evening to see many MS Now reporters in ball gowns and tuxedos as they reported on the violence at the WHCD . Clearly, they attended the WHCD knowing that Trump would once again attack the press.
The press isnât responsible for Trumpâs attempt to criminalize political speech. But they are responsible for failing to resist his actions. He has been led to believe that criminalizing free speech is cost-free. It is our collective job to dispel that notion. And the press must lead the way, rather than rewarding Trump for behavior antithetical to the First Amendment--which is both the source and guarantor of the mediaâs existence.
Quick update on Trumpâs war on Iran
Trump has told aides to prepare for a long blockade of Iranâa move that will inflict maximum pain and disruption on everyoneâUS consumers and the economies of Iran, the EU, and Asia. Like Trumpâs attempt to criminalize political speech, the plan for an âindefiniteâ blockade is a sign of desperation and lack of planning. An indefinite blockade will increase gasoline prices and further depress Trumpâs favorability ratings. Even if the stalemate in the Persian Gulf fades from the headlines, the economic costs will not disappear. Trump is trappedâand has dragged America into the quagmire with him.
Concluding Thoughts
Tonight, I attended a screening of the documentary I mentioned several weeks ago. The documentary focuses on dozens of Americans working in the resistance; I appear in the movie based on a readerâs suggestion to the director/producer. The trailer is here:Â Lightworkers | Trailer.
The documentary reminded me again that one of the most important aspects of resistance is serving as an example to others during fraught times. Trumpâs indictment of Comey is intended to make each of us think twice before we criticize Trump. It is okay to experience fear, but we must not surrender to it. Courage is doing the right thing, even when we are afraid. It is a natural human response to be afraid and anxious.
Our nation is calling us to rise above our fear and anxiety, to step outside of our comfort zones, and to meet the moment. We are up to that task, as we have proved over the last year and the four years of Trumpâs first term. We only need to keep up the good work, and we will win. It will not be easy, but nothing worthwhile ever is.
