I use the Bluebook in practice (civil, complex) constantly. Don’t tell people it’s not used, you’re doing them a disservice by telling them that a vital skill isn’t necessary.
This ask genuinely pissed me off, though I’ll admit I was already pretty angry this morning about a new development in the crimmigration field, so I was primed for it. My anger is probably not about this ask.
This is a good example of how the way you approach someone can have a very outsized impact on how they view the information you’re providing. Being told not to say something in nearly any context will probably get me to say it louder and at greater length.
So: my Blue Book died in a flood. I never got a replacement. Most judges don’t care if you use italics or underlines and you can find out beforehand if yours cares. If you nudge something into a format that looks basically like Bluebook and can successfully point the reader at the thing, you’ll fool 98 out of 100 practitioners. You will absorb the basic formatting of legal citations.
I appreciate the information about your practice (civil, complex). I hear federal court may be different as well. For the information of the reader, I’m in state court. When I say “no one,” it would have been more accurate to say that extremely few people in my field and in my proximity bother with the intricacies of strange legal citations except in extreme circumstances, and then they google it. The Blue Books gather dust while we’re all up in our evidence law supplements and code books. And I do know how to use it correctly because I did my tour of duty on law review.
For non-lawyer readers, the Blue Book is a whole ass encyclopedia about the Right Way to cite sources in lawyer text. Yes, it needs a book. Yes, it’s horrendous. I was thrilled to yeet that waterlogged piece of shit into the dumpster.
