Hiii
I've seen a lot of discussion about the black mold induced UK supreme ruling, but all of it is about perisex trans women. Do you have any ideas or information about how this law affects intersex people?
It never mentions intersex or even DSD but this will absolutely cause a ripple effect and affect all of us
I hate the BBC but I'm not going to read the entirety of an 88 page ruling so here are what I believe to be some important snippets (link):
Elsewhere[…], Lord Hodge, Lady Rose and Lady Simler write: “The definition of sex in the Equality Act 2010 makes clear that the concept of sex is binary, a person is either a woman or a man.”
Continuing, “Although the word ‘biological’ does not appear in this definition, the ordinary meaning of those plain and unambiguous words corresponds with the biological characteristics that make an individual a man or a woman."
“These are assumed to be self-explanatory and to require no further explanation." "There are no circumstances in which a biological male can become pregnant"
🙃🙃🙃
I'm honestly not entirely informed on how sex designation changes after infancy go for intersex individuals in the UK, I barely understand how it happens in the states 😵💫 it seems to be mainly focused on removing any access to "female only" services (sports, bathrooms, grants, help centers, housing) based on male assignment at birth/original birth certificate but...
It's not just trans women either, they do mention trans men, naming them "as women" or "women living in the male gender" (trans women are referred to in a similar manner). On page 68, the court decided it can be proportional to exclude trans men "because the gender reassignment process has given them a masculine appearance or attributes to which reasonable objection might be taken in the context of the women-only service being provided." This can include sports, rape/DV services, and probably uterine care. It can absolutely be used against all intersex women
I did skim it a bit, and also saw it also explicitly states "freedom of association for lesbians and gay men", including trans men in the exclusion.
I don't think nonbinary individuals will have any sort of legal recognition in the UK anytime soon :/
