Younger queer people need to realize that the SOR being used against queer people simply for being queer isn’t some ancient history thing. It still impacts queer people today. And it can quite easily be used that way again.

When you hear people throwing around the talking point of “well there’s a high rate of sex offenders in the trans/queer community”, this has to do with why.

Being on the sex offender registry isn’t inherently equivalent to whatever horrific sex crime you’re meant to think of when it’s mentioned. It evokes imagery of pedophilia and rape, but there is a lot that can get you put on it and not a lot you can do to be taken off of it.

Public crossdressing used to be able to get you put on the sex offender registry (and by used to I mean as recently as 2011).

Public urination (you know, the literal only option for someone who’s homeless and doesn’t have access to public bathrooms, a venn diagram where trans people are more likely to rest in the meeting zone) can get you put on the sex offender registry.

Sex work is pretty much an automatic way to end up on the sex offender registry if you’re caught. (This is especially weaponized against black trans women who do sex work)

“Deviant Sexual Intercourse” (aka literally any sexual activity aside from penis-in-vagina penetration) could get you on the sex offender registry as recently as the early 2000s. That effectively impacts the entire queer community in one way or another.

The sex offender registry is, first and foremost, useless. It tells you nothing about what someone did. It’s mentioned to quickly associate a person or a group of people with the worst possible crimes imaginable.

It has been used against us time after time and it will continue to be used for that.

As much as 25% of people on SORs are juveniles. I think that’s a little fucked up.

They do a lot of harm. Yes, I would want to be able to look up a prospective partner’s records, especially if I had children. But I don’t want shit like public urination or 17-year-olds texting nudes to each other or someone doing gay shit to be something that follows them for years, or forever. I WANT to know if my date raped someone or molested his child.

And they are absolutely weaponized against queer people. Using the wrong toilet could get you on there, if your state outlaws trans people using the bathroom. Wearing the wrong clothes. Being near kids while crossdressing.

Some states are pushing for the death penalty for sex crimes against kids.

Some states are pushing for crossdressing/drag to be labeled as a sex crime against kids.

Do the math on that one. It isn’t a coincidence.

FACT CHECK: Is Oral Sex Still Illegal in 18 States?

While some states still have anti-sodomy laws on the books, they are unenforceable because of a 2003 Supreme Court ruling.

Laws against oral sex are unenforceable after Lawrence v Texas in 2003. But the laws are still on the books. And more notably: Before 2003, people could be arrested for having oral sex, and wind up being registered as a sex offender, permanently.

The sex offender registry is not “people who have committed horrible dangerous sex crimes.” It’s very often “people who have offended their local communities by having a sex life.” Or “wearing clothes that some people believe only certain people are allowed to wear in public.” Or, in some cases, “people who are homeless” - there are areas where homeless people were pissing in an alley because there were no bathrooms, and the police got tired of charging them with misdemeanors that got dropped (because, y'know, no bathrooms) so they switched the charge to “public indecency” and PRESTO! Sex offense, sex offender registry, and a felony on their record!
