two of my trans friends from the US who applied for and got refugee status in canada have informational PDFs they wanted me to share for anyone interested in applying for refugee status as well, since there's been a lot of misinformation around online suggesting it's an impossibility. it's not effortless and they've had to work with a lawyer, but 245 people from the US successfully got refugee status last year, which was an increase from the year before.

i can put ppl in contact with said refugee friends and or answer questions through them to the best of my ability, but the basics they wanted me to pass around are the claims process flowchart and the refugee claim orientation guide. (please let me know if either link isnt functioning) and the general info that you're more likely to get approved working with a lawyer in your province of choice and slowly building a case than doing an at border crossing application.

correction here:

every single source when googling anything related to the number 245 and refugees from the us last year explicitly refers to it being the number of people from the us who applied for refugee status in canada in the first half of the year. that is a very different thing from the number who got accepted, and its misrepresenting the situation hugely to claim its the latter.

i adjusted the original post and i apologize ! i wasnt trying to misrepresent on purpose i just heard this part through a verbal conversation with said friends and obviously misunderstood and should have fact checked before repeating

but yes, that is 245 people who applied at all from the US, and i can't find a number on who has been accepted, bc we won't really know for awhile since it takes 1 to 3 years to process those claims

i should also specify my friends began this process well over a year ago, are just now close to getting their work permits, and have been in various temporary housing situations across the province for a few months and it has been draining financially and emotionally, and just difficult to find housing for 2 ppl and 2 cats. so i rlly dont mean to like oversell the accessability or ease of doing it at all.

im tryna think what else. they also said they personally were willing to stay and appeal as long as they needed to if necessary, even if it just got them to the other side of a trump presidency. (im not so sure trans rights are a guarantee post trump but, thats a whole other thing) and also it does mean you can't return to the US without essentially nullifying your claim that you are unsafe there.

I reached out to Battista Migration Law Group, the immigration law firm OP's friends have been working with, and they provided this additional clarification:

"Thank you for reaching out and providing an overview of your situation. We know this is an incredibly alarming time for the trans and queer community in the US.

I can confirm that Canada does allow US citizens to file refugee claims - however, I do want to make an important clarification. The asylum process in Canada takes several years. While our office has filed several refugee claims for trans Americans over the last year or so, none of these claims have yet reached the point in the process where a determination has been made on the merits of the case. It typically takes about 3+ years for a claim to make its way through the system, so we just have not reached that point yet. However, once a claim is filed and is pending, a claimant is provided with temporary protected status in Canada while they await determination on the claim.

We would be happy to meet with you to discuss this more, as well as to explain how the process works and how we can assist. We typically begin with a consultation with one of our lawyers. Our consultation fee ranges between $400-500 USD, depending on the lawyer. This fee is credited towards overall legal fees if our services are retained within our 5-day consultation credit window.

A member of our intake team will reach out to you directly to provide the lawyers' upcoming availability and to assist in scheduling you in for a consultation should you wish to proceed.

damn im so sorry for misunderstanding the situation so severely yall, i thought bc they were actively living in canada it meant they had been granted official status but their case is very much still pending and yes will likely take at least another 3 years. thank you sm to trangoldin for messaging with me abt this + said friends for explaining further.

i also wanted to specify that they landcrossed the border going on Vacation for a month, managed to get a decent amount of their stuff (somes still in a storage unit back home) and 2 cats across with them, and started living in airbnbs and hotels while finishing up and submitting their basis of claim before hitting the 6 month limit americans have to vacation in canada. but they are about to get work permits after living off savings and their art, got bank accs, and from my understanding will be able to live and work in the province with that temporary protected status at worst until that basis of claim is denied, and still have options to appeal a denial from there. so thats what they meant by being able to at least get to the other side of a trump presidency.

i also saw a couple people mention in tags and wanted to bring up and specify more abt another possible avenue for ppl wanting to come here. since bill C3 passed, the first generation limit was deemed unconstitutional, meaning if you are able to prove you are descended from someone who was born in canada, however far back, you can apply for proof of citizenship and if approved your citizenship is considered immediate and retroactive. so for example my half sister born in the us would have to gather birth records and marriage certificates/name change records for our great great grandmother all the way down to her and pay 75 CAD to submit the application

but this also has the caveat that in june the IRCC started sending some people threatening letters and emails directing them to surrender their citizenship certificates and stating they were issued in error due to lacking original birth certificates and/or metadata, contradicting their own statement on what evidence was acceptable. (these people arent all immediately being kicked out either and many are fighting it) but if you try for this you should be checking out the canadian governments archives rather than ancestry dot com and again it is probably best to save up for a lawyer who has a better understanding of navigating everything

also while we're all here can i stress my trans friends are About to get work permits but don't have them in hand yet so if you want to order something from one of their etsy's that would be really cool and helpful

Hey so a small thing that literally everyone who sees this is capable of is correcting any “used to” statements about native people in this country.

“Native people used to live in this National Park” No. They still do.

“Native people used to tell these stories-” No. They still do.

“Native people used to use this plant as a natural remedy-” No. They still do.

Better yet, familiarize yourself with the tribes local to you. Odds are, they do not yet have federal recognition. You can still read the stories they have to share, you can share their ongoing battle for recognition with others, you can sign petitions and spread the word to others to do so as well. But do something.
