An inside look at a first-of-its-kind lawsuit at the center of the fight over reproductive rights.
Often, they texted about Jess’s troubled marriage. “Y’all have been a rock for me,” Jess wrote at one point. “You’ve helped me know what I am worth and I am thankful for it.” By May 2022, Jess filed for divorce. She shared two kids and a house with Marcus Silva, and they were still living together when, two months later, Jess took a pregnancy test. It was positive. She appeared to be early in her first trimester. The other Bebes rallied around her: They sent messages of support (“mistakes happen, you can’t spiral”), gave her a little bit of tough love (“stop fucking Marcus…I know you know that—but I can’t leave it unsaid”), and tried to help her figure out her options.
A month after the divorce was finalized, in March 2023, Jess’s ex-husband Marcus filed a wrongful death lawsuit. Using photos taken of exchanges in the Bebes text thread as evidence, he sought $1,000,000 in damages from both Noyola and Carpenter over Jess’s alleged abortion. This first-of-its-kind lawsuit to be filed post-Dobbs may be a bellwether in the fight over reproductive rights.

“She’s getting them at 8/830 tonight so I’ll have to meet her after that,” Noyola texted the Bebes thread, apparently about meeting her contact. The pills would be free. Then Noyola wrote, “Delete all conversations from today,” before adding, “You don’t want him looking through it,” referring to Jess’s ex, Marcus.
If Jess did follow Noyola’s advice, she wasn’t fast enough. On July 12, according to a police report reproduced in legal filings, Marcus went into his wife’s purse, found a Post-it note with an abortion hotline written on it, then went through her phone, discovering text messages “between his wife and several other people planning out the purchase and delivery of the abortion,” the officer wrote. (Multiple requests for interviews with Marcus, through his lawyers, were not granted or not responded to.)
According to Marcus’s report to the police, the next day, he rifled through her bag again and found a pill, then used an online pill identifier, which said it was “the first pill used in the abortion process.” According to a text sent by Jess—one that appeared in court documents, but not Silva’s filings—she’d hidden the pill in the wrapping of a panty liner in her purse. Almost a week later, Marcus went to a police office and filed a report. The officer wrote that Marcus “was upset that [Jess] did not at least have this conversation with him,” and was mad at those helping his wife because of the possibility of complications. According to Silva’s legal filings, the Galveston DA had already announced that Jess would not face criminal prosecution.
Despite fearmongering, medication abortion, which has been studied for decades, is widely considered safe and effective—so much so that the World Health Organization suggested it can be self-managed up to 12 weeks under certain circumstances.
Texas’s wrongful death statute was expanded in 2003 to include the death of an “unborn child” beginning at fertilization. Marcus’s lawsuit made the controversial claim that “a person who assists a pregnant woman in obtaining a self-managed abortion has committed the crime of murder and can be sued for wrongful death.” As a legal historian of reproduction policies in the U.S., Mary Ziegler puts it, the suit essentially argues that “there is no such thing as a self-managed abortion.”

In the countersuit, Noyola and Carpenter used the police report to argue Marcus hadn’t recently found out about the alleged abortion, as his suit claimed, but knew in advance. According to the countersuit, Jess allegedly self-administered the abortion medication on July 14, the day after Marcus reported discovering a pill in her purse. Noyola and Carpenter allege that Marcus wasn’t interested in stopping an abortion, instead, he wanted evidence that he could leverage against Jess.

Marcus does not give a rat's ass about Jess's health, or the pregnancy. All he wants to do is punish Jess, and everyone who helped her escape him. He wants control and to terrorize her after leaving him.
It has nothing to do with the abortion, the pregnancy, any of it - it is all about getting revenge on everyone he thinks wronged him by getting her out from under his thumb.

Please please please PLEASE keep your cats indoors right now. H5N1 (HPAI, highly pathogenic avian influenza) is zoonotic to cats, and it is just as deadly for them. Additionally, if you have a way to keep your shoes away from your cat(s), or sanitize them after being out in the world (bleach footbath for example), a little biosecurity wouldn't hurt.
A sanctuary in Washington just lost 20 of their rescue big cats to this virus. It is not getting less dangerous for your cats this year than it was last.
The people who run this sanctuary here on Harstine Island say the death of the cats feels like a death in the family.
It has ALWAYS been dangerous to let house cats free roam without supervision, but it's becoming dangerous right now to be taking them on leashes if they will have access to ground birds have recently been on, or water they have accessed. Catios might be okay, if they're covered and well-screened, but I would take a moment to subscribe to your local state ag department's email or phone alerts for HPAI in your area, and react accordingly even for covered outdoor areas.

n all seriousness sesame street is such an important piece of living media. it has been around for DECADES and from day 1 highlighted the importance of diversity empathy and education for children in a fun way. their mission statement is “Helping Kids Everywhere Grow Smarter, Stronger, and Kinder”. it’s been such an influence for so many people at a formative age. it’s creators made it w the intention that it could be a resource for underprivileged kids and help them prepare for kindergarten. thousands of people have learned english from our friends on sesame. pls (at media corporations) don’t let a beloved cultural phenomenon die

you can find plenty more information on Project 2025 on any reputable news source, but I thought I’d confirm OP wasn’t full of fear-mongering shit, ‘cuz this is insane.

The important thing I’d note is that while this transition plan and objective set was created for Donald Trump, it is not necessarily specific to him—this is the distillation of what conservatives have wanted for a long time and WILL CONTINUE TO PUSH FOR even after Trump is no longer in the picture someday. They are proposing it now because they know Trump will be likely to enact these proposals, but understand this: the things outlined in the graphics above are the world the Republican Party envisions going forward regardless of who their candidate is. They are not going away. Unless time and time again those who oppose this vision fight the Republicans at every level of government, one by one the hard fought wins those in the past have achieved will be stripped away.
Look, I have no idea what’s going to happen at the top of the Democratic ticket. And I will be the very first to list the problems I have with the way the Democratic Party is run. But I firmly believe that helping the Democrats defeat the extremely harmful things the other side wants to do needs to be a priority, and that the only way the Democrats ARE going to get reformed and start finally listening to the people they claim to represent is by making changes while working inside and alongside the party. Remembering what stands to be lost is a good reminder on why it’s important not just to throw up our hands and say it’s all fucked and there’s no hope for politics.

Gee, Tumblr would probably really hate it if you shared and spread this damning article … To the surprise of absolutely none of Tumblr’s LGBTQ users, it turns out the independent NYC human rights agency Commission on Human Rights (CCHR) found that Tumblr’s ham-fisted adult content ban in December 2018 disproportionately targeted LGBTQ users. The CCHR’s investigation revealed Tumbler’s moderation algorithms is demonstrably biased against queer content. As part of the settlement, Tumblr was obligated to review their prejudicial anti-gay moderation policies. Even more mortifyingly, they’ve also had to hire an expert on sexual orientation and gender identity (SOGI) issues and provide unconscious bias training to their moderators. I frankly doubt Tumblr has learned a thing from this humbling experience. Just recently the Tumblr algorithm flagged three ancient posts of mine as violating their terms. All three “offenders” were vintage homoerotic beefcake images (softcore by modern standards) roughly 50 – 65-years-old by Bruce of Los Angeles, Bob Mizer and Tom of Finland. (These are of course pioneering queer artists who routinely faced censorship and imprisonment in the fifties and sixties. Plus ca change!). They've been visible on my page - corrupting viewers - for years at this point. I appealed all three immediately. Only the Tom of Finland one was approved. The other two are now hidden. So, they haven't learned much. Apparently, Tumblr – who loves to declare how hip, youthful, inclusive and progressive their values are - wants to restore trust with their queer users. I’d recommend we remember their hypocrisy when Pride rolls around and Tumblr splashes rainbow flags everywhere and attempts to pink wash their image.
